Gas Amendment (Definition of Tariff

Customer) Regulation 1996

Gas Supply Act 1996

His Excellency the Governor, with the advice of the Executive Council, has made the following Regulation under the Gas Supply Act 1996.

Explanatory note
The object of this Regulation is to amend the Gas Regulation 1991:

(a) to declare persons whose consumption of natural gas is less than 10 terajoules per year to be tariff customers for the purposes of the Gas Supply Act 1996, and
(b) to make other amendments consequential on the enactment of the Gas

Supply Act 1996.

83 (the general regulation making power), clause 1 of Schedule 2 (the power to make regulations of a savings or transitional nature) and the definition of tariff customer in the Dictionary to that Act.

One of the amendments renames the Gas Regulation 1991 as the Gas Supply
Regulation 1991.

1 Name of Regulation

This Regulation is the Gas Amendment (Definition of Tariff

Customer) Regulation 1996.

2 Commencement

This Regulation commences on 12 July 1996.

3 Amendment of Gas Regulation 1991

The Gas Regulation 1991 is amended as set out in Schedule 1.

4 Explanatory note

The explanatory note does not form part of this Regulation.

4 Definition of tariff customer

Any person who is supplied with natural gas, at a rate of 10 terajoules per year or less, by means of an authorised reticulator’s distribution system is declared to be a tariff customer for the purposes of the definition of tariff customer in the Dictionary to the Act.

52 Variation of conditions of authorisations arising under

clause 3 of Schedule 2 to the Act

(1) This clause applies to an authorisation arising under
clause 3 of Schedule 2 to the Act.
(2) Section 12 of the Act applies to the variation of the conditions of an authorisation to which this clause applies (including any condition that relates to the price that may be charged for the supply of gas) in the same way as it applies to the variation of the conditions of an authorisation granted under section 9 of the Act.
(3) This clause is subject to clause 3 (3) of Schedule 2 to the
Act.
