Gas Standards (Gas Supply and System Safety)

Amendment Regulations 2010

Made by the Lieutenant-Governor and deputy of the Governor in

Executive Council.

Part 1 — Preliminary matters

1.             Citation

These regulations are the Gas Standards (Gas Supply and
System Safety) Amendment Regulations 2010.

2.             Commencement

These regulations come into operation as follows —

(a)	Part 1 — on the day on which these regulations are published in the Gazette;
(b)	the rest of the regulations — on the day after that day.

Part 2 — Gas Standards (Gas Supply and System Safety)

Regulations 2000 amended

3.             Regulations amended

This Part amends the Gas Standards (Gas Supply and System
Safety) Regulations 2000.

4.             Regulation 3 amended

(1)	In regulation 3(1) delete the definitions of:
AG network operator
(2)	In regulation 3(1) insert in alphabetical order:

network operator —

(a)	means an undertaker who operates a distribution system; and
(b)	in relation to a prescribed activity for the purposes of a distribution system, includes any contractor, and any subcontractor, to the system’s network operator who is contracted to carry out the prescribed activity;

5.             Regulation 15 amended

In regulation 15(1) delete “AG 702.” and insert:

AS 4647-2005 Domestic diaphragm gas meters.

6.             Regulation 25 amended

(1) In regulation 25(1A):

(a)	delete the definition of employee;
(b)	in the definition of contractor delete “the operator;” and insert:

the operator.

(2) Delete regulation 25(2A).

7.             Regulation 27 amended

Delete regulation 27(2) and insert:

(2) The safety case must comply with each of these
standards —

(a) AS/NZS 4645.1:2008 Gas distribution

networks Part 1: Network management;

(b)

if it applies to the distribution system — petroleum Part 1: Design and construction;

(c)

if it applies to the distribution system — petroleum Part 3: Operation and maintenance.

8.             Regulation 44 amended

(1) Delete regulation 44(1)(b) and insert:

(b)	within 14 days after the incident occurs, prepare and give to the Director a preliminary or final report on the investigation; and
(c)	if the network operator gives the Director a preliminary report — within 30 days after the incident occurs, prepare and give to the Director a final report on the investigation.

(2)	Delete regulation 44(3) and insert:
(3) A report under subregulation (1)(b) or (c) must be in writing and in a form acceptable to the Director.

9.             Schedule 1 amended

In Schedule 1 delete “Mainly tetra hydor phiophene (THP)” (each
occurrence) and insert:

Mainly tetra hydro thiophene (THT)

10.           Schedule 2 replaced

Delete Schedule 2 and insert:

obligatory provisions for network operators

Amendment Regulations (No. 2) 2009 amended

11.           Regulations amended

This Part amends the Gas Standards (Gas Supply and System
Safety) Amendment Regulations (No. 2) 2009.

12.           Regulation 12 amended

(1) In regulation 12 in the insertion in regulation 23(1):

(a)	delete the definition of employee;
(b)	in the definition of contractor delete “the operator;” and insert:

the operator.

(2)	In regulation 12 in the insertion delete regulation 23(3).
(3)	In regulation 12 in the insertion in regulation 23(4) delete “(4) Work” and insert:
(3) Work
