Gas Services Information Amendment

Regulations (No. 2) 2016

Made by the Governor in Executive Council.

1.             Citation

These regulations are the Gas Services Information Amendment
Regulations (No. 2) 2016.

2.             Commencement

These regulations come into operation as follows —

(a)	regulations 1 and 2 — on the day on which these regulations are published in the Gazette;
(b)	regulation 9(2) — on 3 April 2017;
(c)	the rest of the regulations — on the day on which the Energy Industry (Rule Change Panel) Regulations 2016 regulation 4 comes into operation.

3.             Regulations amended

These regulations amend the Gas Services Information
Regulations 2012.

4.             Regulation 3 amended

In regulation 3(1) insert in alphabetical order:

Rule Change Panel means the Rule Change Panel
established by the Energy Industry (Rule Change
Panel) Regulations 2016 regulation 4;

5.             Regulation 7 amended

Delete regulation 7(4) and insert:

(4) Despite anything in this regulation or the GSI rules —

(a)	rules replacing the GSI rules in whole are to be made by the Minister and regulation 6(5) applies to them; and
(b)	rules dealing with the matters referred to in regulation 8(2)(c) in relation to the Rule

rules amending, repealing or replacing GSI before they are made.

6.             Regulation 8 amended

(1)	In regulation 8(1) after “operator,” insert:
the Rule Change Panel (to the extent to which those functions relate to the matters referred to in regulation 7(2)),
(2)	In regulation 8(2):

(a) in paragraph (c) delete “operator” and insert:

operator, the Rule Change Panel

(b) in paragraph (d)(i) after “operator,” insert:

the Rule Change Panel,

(c) in paragraph (d)(ii) delete “Act;” and insert:

Act; and

(d) after paragraph (d)(ii) insert:

(iii)      the performance of the functions of the ERA under the Energy Industry (Rule Change Panel) Regulations 2016 to the extent to which they are functions under the Act;

7.             Regulation 8A amended

(1) In regulation 8A(1):

(a) after “ERA” (1st occurrence) insert:

or Rule Change Panel

(b) in paragraphs (a) and (b) delete “ERA; and” and insert:

ERA or Rule Change Panel; and

(c) in paragraph (c) delete “ERA.” and insert:

ERA or Rule Change Panel.

(2) In regulation 8A(2):

(a) after “ERA” (1st occurrence) insert:

or Rule Change Panel

Note: The heading to amended regulation 8A is to read:

8.             Regulation 9 amended

(1) In regulation 9(1):

(a) delete “IMO” and insert:

ERA

(b)	delete paragraph (b) and insert:
(b) on a website maintained by the ERA.

(2) In regulation 9(2):

(a) delete “IMO” and insert:

ERA

(b) delete “GSI website” and insert:

website referred to in subregulation (1)(b)

9.             Regulation 11 amended

(1)	In regulation 11(3) delete “functions, and the GSI rules.” and insert:
functions.
(2)	After regulation 11(4) insert:
(5) The Rule Change Panel is responsible for the development, in accordance with the GSI rules, of amendments of and replacements for the GSI rules.
