Gas Safety (Gas Installation) Amendment Regulations 2014

The Governor in Council makes the following Regulations:

1Objective

The objective of these Regulations is to amend the Gas Safety (Gas Installation) Regulations 2008—

(a)to prescribe new standards with which gasfitting work, gas installations and flueless space heaters in residential premises must comply; and

(b)to provide for certain standards adopted by those Regulations to be adopted as published or amended from time to time; and

(c)to make minor technical amendments to improve the operation of those Regulations.

2Authorising provision

These Regulations are made under section 118 of the Gas Safety Act 1997.

3Commencement

These Regulations come into operation on 31 March 2014.

4Principal Regulations

In these Regulations, the Gas Safety (Gas Installation) Regulations 2008[1] are called the Principal Regulations.

5Definitions

In regulation 5 of the Principal Regulations—

(a)in the definition of AS3814, for "AS3814 means Australian Standard" substitute "AS 3814 means AS 3814";

(b)for the definition of AS 5601 substitute

'AS/NZS 5601.1 means AS/NZS 5601.1, "Gas installations—Part 1: General installations";

AS/NZS 5601.2 means AS/NZS 5601.2, "Gas installations—Part 2: LP Gas installations in caravans and boats for non-propulsive purposes";';

(c)in the definition of consumer piping, for "AS 5601" substitute "AS/NZS 5601.1";

(d)in the definition of gas pressure regulator

(i)for "same" substitute "same";

(ii)for "AS 5601" substitute "AS/NZS 5601.1";

(e)in the definition of operating pressure, for "AS 5601" substitute "AS/NZS 5601.1";

(f)in the definition of pressure, for "AS 5601" substitute "AS/NZS 5601.1";

(g)in the definition of rated working pressure, for "AS 5601" substitute "AS/NZS 5601.1";

(h)insert the following definition—

"commercial catering equipment means commercial catering equipment as described in section 6.10.2 of AS/NZS 5601.1;".

6Application of adopted standards

In regulation 7(2) of the Principal Regulations, after "as" insert "published or".

7Regulation 15 substituted

For regulation 15 of the Principal Regulations substitute

"15   Prescribed standards for gasfitting work

(1)For the purposes of section 72(1) of the Act—

(a)the prescribed standard in relation to gasfitting work to which AS/NZS 5601.1 applies is that standard; and

(b)the prescribed standard in relation to gasfitting work to which AS/NZS 5601.2 applies is that standard.

(2)For the purposes of section 72(1) of the Act, the prescribed standard in relation to gasfitting work carried out in connection with commercial catering equipment on or in a boat or caravan is AS/NZS 5601.1.

(3)In subregulation (2), boat and caravan have the same meanings as they have in AS/NZS 5601.2.".

8Regulation 18 substituted

For regulation 18 of the Principal Regulations substitute

"18   Prescribed standards for gas installations

(1)For the purposes of section 72(2) of the Act—

(a)the prescribed standard in relation to an appliance or gas installation to which AS/NZS 5601.1 applies is that standard; and

(b)the prescribed standard in relation to an appliance or gas installation to which AS/NZS 5601.2 applies is that standard.

(2)For the purposes of section 72(2) of the Act, the prescribed standard in relation to commercial catering equipment on or in a boat or caravan is AS/NZS 5601.1.

(3)In subregulation (2), boat and caravan have the same meanings as they have in AS/NZS 5601.2.".

9Regulation 28 substituted

For regulation 28 of the Principal Regulations substitute

"28   Prescribed standards for flueless space heaters

For the purposes of section 72(2) of the Act—

(a)the prescribed standard in relation to a flueless space heater, in residential premises, to which AS/NZS 5601.1 applies is that standard; and

(b)the prescribed standard in relation to a flueless space heater, in residential premises, to which AS/NZS 5601.2 applies is that standard.".

10Schedule 1 amended

In Schedule 1 to the Principal Regulations, for "AS 5601—Gas installations (to the extent that it applies to gas in Victoria)." substitute

"AS/NZS 5601.1—Gas installations—Part 1: General installations.

AS/NZS 5601.2—Gas installations—Part 2: LP Gas installations in caravans and boats for non-propulsive purposes.".
