Gas Industry (Penalty Regime) Amendment Regulations 2023

The Governor in Council makes the following Regulations:

1Objective

The objective of these Regulations is to amend the Gas Industry (Penalty Regime) Regulations 2022 to prescribe amounts for contraventions of civil penalty requirements specified in the Gas Distribution System Code of Practice.

2Authorising provision

These Regulations are made under section 236 of the Gas Industry Act 2001.

3Definitions

In regulation 4 of the Gas Industry (Penalty Regime) Regulations 2022[1] insert the following definition—

'Gas Distribution System Code of Practice means the Code of Practice made under section 47(1) of the Essential Services Commission Act 2001 and entitled "Gas Distribution System Code of Practice";'.

4Table 1 in Schedule 2 amended

After item 80 of Table 1 in Schedule 2 to the Gas Industry (Penalty Regime) Regulations 2022 insert—

"Gas Distribution System Code of Practice
81.	Clause 4A.3.1(a).
82.	Clause 4A.3.1(b).
83.	Clause 4A.3.1(c).
84.	Clause 4A.3.1(d).
85.	Clause 4A.4.
86.	Clause 4A.6(a).

89.	Clause 4A.8(a).
90.	Clause 4A.8(b).
91.	Clause 4A.8(c).
92.	Clause 4A.13(a).
93.	Clause 4A.13(b).".

5Table 2 in Schedule 2 amended

After item 153 of Table 2 in Schedule 2 to the Gas Industry (Penalty Regime) Regulations 2022 insert—

"Gas Distribution System Code of Practice
154.	Clause 2.2(b).".
