I, the Governor in and over the State of Tasmania and its Dependencies in the Commonwealth of Australia, acting with the advice of the Executive Council, make the following order under section 3(3) of the Gas Act 2000 .20 December 2001

1Short titleThis order may be cited as the Gas (Distribution System) Order 2001 . 2CommencementThis order takes effect on the day on which its making is notified in the Gazette. 3InterpretationIn this order, Act means the Gas Act 2000 . 4Class of pipelines not to be part of distribution systemFor the purposes of section 3(3) of the Act, a pipeline which delivers, or is capable of delivering, natural gas directly to a customer on land comprised in the particulars of title specified in column 2 of the Table in Schedule 1 to this order is to be treated as not forming part of a distribution system if – (a) in the case of a proposed pipeline, the pipeline is not to be owned or operated by the holder of an exclusive franchise under section 30 of the Act; or (b) in the case of a pipeline constructed before the commencement of this order, the pipeline is not owned or operated by the holder of any such franchise.
