GAS CORPORATION ACT 1994

GAS DISTRIBUTION AMENDMENT REGULATIONS 1998

Made by the Governor in Executive Council.

Citation

1.     These regulations may be cited as the Gas Distribution Amendment Regulations 1998.

Commencement

2.     These regulations come into operation on the commencement of the Dampier to Bunbury

Pipeline Regulations 1998.

Principal regulations

3.     In these regulations the Gas Distribution Regulations 1996* are referred to as the prin-

cipal regulations.

Regulation 4 amended

4.     Regulation 4 of the principal regulations is amended —

(a)

by deleting the definitions of “gate station”, “linked application”, “transmission ap- plication”, “transmission business”, “transmission contract”, and “transmission in- formation system”;

(b)

by inserting in their appropriate alphabetical positions the following — “

“access contract” means a contract between the DBNGP owner and a

shipper for access to gas transmission capacity;

”;

“DBNGP owner” has the same meaning as it has in the Dampier to

Bunbury Pipeline Act 1997;

”;

“gas transmission capacity” has the same meaning as it has in the

Dampier to Bunbury Pipeline Act 1997;

“gas transmission system” means the privatized DBNGP system as de-

fined in the Dampier to Bunbury Pipeline Act 1997;

“gate station” means the metering equipment site associated with a physi- cal gate point and includes all facilities installed at the site to perform over pressure protection, reverse flow protection, excessive flow protec- tion, gas metering and measurement and telemetry and all standby, emergency and safety facilities and all ancillary equipment and services;

”;

“linked application” means an application in respect of which the appli- cant requests under regulation 32 that a grant of access be not made unless an access contract is entered into in response to a transmission application specified in the request;

”;

“shipper” has the same meaning as it has in the Dampier to Bunbury

Pipeline Act 1997;

”;

“transmission application” means an application under regulation 45

of the Dampier to Bunbury Pipeline Regulations 1998;

”;

and

(c)

in the definition of “notional gate point”, by deleting “Gas Transmission Regula- tions 1994” and substituting the following —

Dampier to Bunbury Pipeline Regulations 1998 ”.

Regulation 32 amended

5.     Regulation 32 (2) of the principal regulations is repealed and the following subregulation

is substituted —

(2) The corporation cannot make a grant of access in response to a linked applica- tion unless an access contract has been entered into in response to the transmission application specified in the request under subregulation (1).

Regulation 50 amended

7.     Regulation 50 (2) of the principal regulations is amended by deleting “and” after para-

graph (c) and substituting the following —

“ or ”.

Regulation 52 amended

8.     Regulation 52 of the principal regulations is amended by deleting “and the gas trans-

mission system”.

Regulation 56 amended

9.     Regulation 56 (3) (b) of the principal regulations is amended —

(a)

by deleting “the corporation has under the Gas Transmission Regulations 1994” “

the DBNGP owner has under the Dampier to Bunbury Pipeline Regula-

tions 1998 or a contract

”;

and

(b)

in subparagraph (i), by deleting “capacity of the designated shipper” and substitut- ing the following —

designated shipper’s use of gas transmission capacity ”.

Regulation 64 repealed

10.     Regulation 64 of the principal regulations is repealed.

Regulation 78 amended

11.     (1) Regulation 78 (1) of the principal regulations is amended by deleting “transmission

information system facilities at or related to or connected with distribution outlet points”
and substituting the following —

facilities at, related to, or connected with, distribution outlet points that are re-

quired to connect to the transmission information system

”.

(2) After regulation 78 (2), the following subregulation is inserted —

(3) In this regulation —

“transmission information system” means the electronic information sys- tem operated by the DBNGP owner that provides data electronically to the DBNGP owner and shippers, which may include, but is not limited to, the supervisory control and data acquisition system covering the gas transmis- sion system for control, data collection and telemetry.

Regulation 82 amended

12.     Regulation 82 of the principal regulations is amended —

(a)

by inserting after the regulation designation “82.” the subregulation designation “(1)”; and

(b)

by inserting the following subregulation — “

(2) In subregulation (1) —

“transmission information system” has the same meaning as it has

in regulation 78.

”.

Regulation 87 amended

13.     Regulation 87 of the principal regulations is amended by deleting “delivered by the

corporation at” and substituting the following —

that is to be taken to be passing through ”.

Schedule 1 amended

14.     (1) Clause 1 of Schedule 1 to the principal regulations is amended in the definition of

“prescribed dispute” by deleting “regulation 64” and substituting the following —

“ the Gas Referee Regulations 1995 ”.

(2) Clause 18 (g) of Schedule 1 to the principal regulations is deleted and the following

paragraph is substituted —

(g) if the party is the user and is in default under an access contract for the trans- port of gas to the notional gate point associated with the sub-network in which a distribution outlet point specified in Appendix 3 is located.
