Explanatory note

The object of this Regulation is to declare certain substances to be gases for the purposes of the Gas and

Electricity (Consumer Safety) Act 2017.

This Regulation is made under the Gas and Electricity (Consumer Safety) Act 2017, including the definition of gas in section 4(1) and section 75 (the general regulation-making power).

1      Name of Regulation

This Regulation is the Gas and Electricity (Consumer Safety) Amendment (Medical

Gas Work) Regulation 2020.

2      Commencement

This Regulation commences on 1 November 2020 and is required to be published on the NSW legislation website.

3 Amendment of Gas and Electricity (Consumer Safety) Regulation 2018

Clause 3A

Insert after clause 3—

3A Definition of “gas”—section 4(1)

The following substances are declared to be gases for the purposes of the Act—

(a) oxygen,
(b) nitrous oxide,
(c) helium,
(d) nitrogen,
(e) carbon dioxide,
(f) medical air,
(g) surgical tool gas,
(h) common mixtures of the gases referred to in paragraphs (a) to (g),

(i)      waste anaesthetic gas.
