[ASSENTED TO 9TH DECEMBER, 1933.] E It enacted by the Kmg's Most Exce 1 lent M .a ' Jesty, by and with the advice and consent of the Legis- lative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows:- Short title 1. This Act may be cited as "The GasAct and . Amendment Act of 1933," and shall be read as one with constructlOn. *" T h e G asActof1916' ' (asdamen edbysubsequent 0 r ders in Council), herein referred to as the Principal Act. The Principal Act and this Act may collectively be cited as " The Gas Acts, 1916 to 1933." Amendments of the Principal Act. Amendment 2. Subsection three of section five of the Principal of s. 5. Act is amended by deleting therefrom the words" if so required by the Minister." Amendment 3. Paragraph (b) of subsection three of section of s. 7. seven of the Principal Act is repealed. Amendment 4. Section thirteen of the Principal Act is amended of B. 13. as follows:- (a) In paragraph (i.), after the word "motion," the words "may, from time to time," are inserted; also in the said paragraph (i.), after the words "gas may," the words "from time to time" are inserted. * 7 Geo. GAS. 1459'7 1933. Gas Act Amend1ment Act. The proviso to the said paragraph is repealed. (b) In paragraph (iv.) of the said section the words " for a period of two years and thereafter" are repealed. Where in the said section reference is made to the price of gas, or price, such section shall be -read and construed as if for the words "price of gas" or "price" the words" price or prices of gas" or "price or prices" were respectively inserted therein. 5. Section fourteen of the Principal Act is amended Amendment as follows :_ of s. 14. (a) In subsection one all words occurring after the words "gas Elupplied" where those words secondly occur, to the end of the subsection (ending with the word " therewith") are repealed. (b) The following additional provision is added to subsection one, as follows : - "For gas supplied by any company through any prepayment meter where the cost of the fittings is not borne by the company, the price charged shall not be greater than that fixed for gas supplied by ordinary meter,provided that the sum to be charged in respect of any prepayment meter shall not be less than the minimum charge as prescribed in the Third Schedule of this Act, or any amendment of the said Third Schedule for the time being in force, per month per meter." (c) Subsection two is amended by omitting all words after "maintenance" to the end of the said subsection, and by inserting the following words in lieu thereof, namely: "of the fittings supplied with the prepayment meter." (d) Subsection three is amended by omitting the full stop (.) at the end thereof and by inserting in lieu thereof a semicolon (;); also by adding the following words, namely: "and the expression "fittings" means any illumination fixtures, boiling-rings, grillers, cookers, or other appliances by the use of which gas is consumed." 6. The following subsection is added to section Amendment eighteen of the Principal Act, namely :_ of 8. 18. " (2.) For the purposes of *" The Gas Acts, 1916 to 1933," reference to all or any of the Schedules of this Act * v. 7 Geo. No. 11, 8upra, page 7468, and this Act.

No. 20, means all or any of the Schedules 1., H., and HI., as jnserted by section seven of *" The Gas Act Amendment Act of 1933," in lieu of the Schedules (or any of them) in force prior to the passing of such lastmentioned Act; and all or any of such Schedules may be amended from time to time in manner prescribed by subsection one of this section accordingly." And the original section eighteen is renumbered subsection one accordingly. Schedules. 7. Schedules I., n., and IH. are repealed, and the following new Schedules I., n., and HI. are inserted in lieu thereof, namely :- SCHEDULE I. STANDARDS. (A)-Of Heating PoU'er. The quality of ga.s with respect to its heating value shall be not less than five hundred British thermal units per cubic foot total heating value. (B)-Of Purity. Gas shall, when tested in accordance with this Act, contain- No hydrogen sulphide. Ammonia-Not more than four grains per one hundred cubic feet. (C)-Of Pre881lre. Gas shall be supplied at the inlet of the consumer's meter at such pressure as to balance a column of water not less than twenty- tenths of an inch in height between the hours of 5 a.m. and 10 p.m., and a. column of water not less than fifteen-tenths of an inch in height between the hours of 10 p.m. and 5 a.m. SCHEDULE n. Testing of Gas. 1. The apparatus for testing the heating power of gas shall be the Simmance-Abady Calorimeter. 2. The apparatus for testing the presence in the gas of hydrogen sulphide shall be a glass vessel containing a strip of bibulous paper moistened with a solution of acetate of lead, containing sixty grains of crystallized acetate of lead dissolved in one fluid ounce of water. 3. The apparatus for testing the presence of ammonia shall consist of a glass vessel filled with glass marbles moistened with standard sulphuric acid, and the test shall be carried out so as to show the proportion of ammonia contained in the gas. 4. For the purpose of the test of pressure, the examiner shall use any standard recording gauge approved by the Minister. * This Act.

Total £ 7 per cent. on total £ Provided that the amount of money invested by the company in pipes and fittings on property occu- pied by consumers and being part of the prepay- ment meter installation shall not be taken into account in ascertaining the actual amount of money invested in the gas undertaking. --------------
GAS. 1933. Gas Act Amendment Act. 3. The price or prices chargeable per one thousand cubic feet of gas shall be such that, when multiplied by the amount of gas sold, the result will be a return to the companies of the sum representing the cost of production plus seven per cent. return on the actual amount of money invested in the gas undertaking. For the purposes of this Schedule IlL, the amount of gas sold shall be the total amount of gas made as per station meter less ten per cent. allowance for leakage. Each company shall submit for the approval of the Gas Referee a price or prices that it desires or intends to charge, together with a statement showing the number of consumers and the amount of gas they consume under each rate in their proposed scale of charges. Provision for a discount allowance- (a) Of ten per centum to consumers provided that their accounts are paid within eighteen days of the day of the sending of the account; (b) Of five per centum to consumers provided that their accounts are paid after eighteen days but within thirty days of the day of the sending of the account, may be made by adding one-ninth to the price or prices approved by the Gas Referee; Provided further, that the Company may make a monthly minimum charge for three hundred cubic feet of gas to consumers whose monthly consumption of gas does not exceed three hundred cubic feet; provided always that the monthly minimum charge to consumers under this provision shall in no case exceed an amount of three shillings per month. Provided further that, where the monthly minimum charge is not made, in the event of the consumption per month being less than that shown in the following scale, rent be charged for ordinary meter in addition to the amount payable for gas supplied, at the under- mentioned rate ;- £ 8. d. In ascertaining the price or price!' chargeable for gas consideration shall be given to what is necessary for the efficient and economical management of the undertaking. Without limiting the powers and discretions of the Gas Referee or the Judge on appeal, any payments to directors, officers, agents, or other persons, or by way 14601

No. 9, of commission, rent, or other charge which are found to be unnecessary or excessive shall be disallowed or reduced to such amount as is deemed proper. 5. In ascertaining' the actual amount of money invested in the gas undertalcing, no allowance whatever shall be made for goodwill and for items not required in the business of gas production and distribution. The actual cost of the several items shall be as nearly as possible ascertained, and from such cost due allowance for depreciation, if any, shall be deducted. In ascertaining the amount of depreciation, if any, consideration shall be given to each item as forming part of a continuous gasmaking concern. GOLDEN CASKET LICENSES. See VAGRANTS AND GAMING. Agreement Act 0 1933." *This Act shall c')me into operation on a date to be proclaimed by the Governor in Council by Proclamation published in the Gazette, which date is herein referred to as the commencement of this Act. * Proclaimed to come into force as from 1st January, 1934 (Gazette, 16th December, 1933, page 1490).
