Gas Act Amendment Act 1985, No. 75 1131 BE IT ENACTED by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows:- 1. Short title and citation . (1) This Act may be cited as the Gas Act Amendment Act 1985. (2) In this Act the Gas Act 1965-1981 is referred to as the Principal Act. (3) The Principal Act as amended by this Act may be cited as the Gas Act 1965-1985. 2. Amendment of s. 5 . Meaning of terms . Section 5 of the Principal Act is amended by- (a) in subsection (1), omitting from the definition "Gas undertaking" the words "through mains"; (b) omitting subsection (2) and substituting the following subsection "(2) It is hereby declared that. for the purposes of this Act, "Gas undertaking" always did include the business of supplying or producing and supplying gas to consumers whether through mains or otherwise.". 3. Amendment of s. 12. Application for and grant of franchise. Section 12 of the Principal Act is amended by, in subsection (1), inserting after the words " maintain a " the word "franchised". 4. Amendment of s. 13. Offences in relation to gas undertakings. Section 13 of the Principal Act is amended by- (a) in the note appearing in and at the beginning of the section omitting the words "gas undertakings " and substituting the word "mains"; (b) in subsection (1), omitting from paragraph (a) the words "a gas undertaking" and substituting the word "mains"; (c) in subsection (2), omitting from paragraph (a) the words "a gas undertaking" and substituting the word "mains". 5. Amendment of s. 20. Provisions applicable to a gas undertaking. Section 20 of the Principal Act is amended by- (a) in the note appearing in and at the beginning of the section inserting after the words "to a" the word " franchised"; (b) in subsection (1), inserting after the words "maintenance of a" the word "franchised"; (c) in subsection (2), inserting after the word "particular" where twice occurring the word "franchised".

1 132 Gas Act Amendment Act 1985, No. 75 6. Amendment of s. 34. Application of this Part . Section 34 of the Principal Act is amended by omitting the words " a gas undertaking" where twice occurring and substituting the word " mains " in each case.
