REGULATION'S UNDER THE BUILDING AND SERVICES
ORDINANCE 1924-1923.
PURSUANT to the powers conferred upon it by the Building and Services Ordinance 1924-1928, the Federal Capital Commission, appointed tinder the Seat of Government (Administration) Act 1924-1928, hereby makes the following Regulations" to come into
operation forthwith.Dated this 17th day of October, 1929.

GARBAGE REGULATIONS.
| Short title. | 1. | These Regulations may be cited as the Garbage Regulations. |
| Definitions. | 2. | In these Regulations, unless the contrary intention appears— |
| " Approved " means approved by the proper authority; | ||

authorized by the Commission;
"Garbage" includes all wastes (except sewage) arising from
or existing upon or about any premises;
" Occupier " includes the person having the charge, management or control of premises, and in the case of a house which is let out in separate tenements, or iu the case of a lodging-house which is let to lodgers, the person receiving the rent payable by the tenants or lodgers either on his own account or as the agent of another person, and also includes any person in occupation of the surface of any land of the Commission, notwithstanding any want or defect of title to occupy the land;
" Owner " means the owner whether jointly or severally of any premises, or the authorized agent, manager or superintendent of the owner, and includes a lessee;
" Premises " includes all buildings and structures and any lands within the curtilage thereof, and any portion thereof under separate occupation.

(1) The occupier of every premises shall, within such time as is specified in a notice from the Commission or an authorized officer served on him, provide, for use on the premises for temporarily storing and holding all garbage arising from or existing upon the premises, a sufficient number of watertight receptacles of an approved pattern in accordance with the specification set out in this regulation, and shall maintain those receptacles and keep them in repair to the satisfaction of the Commission. |
| (2) A receptacle to be provided in pursuance of the last preceding sub-regulation shall be of metal not thinner than 24 gauge, circular in shape, twenty inches or thereabouts in height, and sixteen inches or thereabouts in diameter: | |
| Provided that, where authorized or required by the Commission, the receptacle shall be twenty-three inches or thereabouts in height, and eighteen inches or thereabouts in diameter. | |
| (3) The receptacle shall be provided with two handles and have a closely-fitting lid with a flange overlapping the top of the receptacle. | |
| (4) The Commission may provide garbage receptacles iu respect of any premises, and the occupier of the premises shall accept, pay for and use those receptacles which, for the purposes of this regulation, shall be deemed to have been provided by the occupier. | |

6. The occupier of any premises, where a grease trap is provided at Grease traps,

9. (1) Except as provided in this Eegulation, the occupier or owner weekly
of any .premises or land shall cause the whole of the garbage on the ^iSg'efrom
premises or land to be removed therefrom as often as in the opinion of premises,
the Commission is desirable or necessary, and shall cause the garbage
so removed to be destroyed forthwith as directed by the Commission.(2) Where a system of clearance of garbage is established by the Commission, the Commission shall provide one clearance service each week in respect of all premises, for the purpose of removing the contents of receptacles provided at those premises in pursuance of these Eegulations, and any additional service for the clearance of garbage as the Commission thinks necessary or desirable:
Provided that the service shall he for the removal of the contents of one receptacle only, except in those cases where the Commission requires that one receptacle shall be kept for wet garbage and one for dry garbage, when the service shall be for the removal of the contents of each such receptacle:
Provided further that the Commission may arrange for the removal from any premises of garbage in excess of that provided for by this Eegulation and may make a charge of One shilling for each additional receptacle at each such removal.
10. (1) Where a system of clearance of garbage is established by Eeceptacies v J

the Commission, the occupier of any premises shall, at such time as tne accessible for Commission or an authorized officer specifies, locate all receptaclescoUect |on- provided on the premises in pursuance of these Eegulations, for the purpose of the removal of the contents, in such place as the Commission or an authorized officer specifies.
(2) Any servant or employee of the Commission, or any contractor with the Commission, or any servant or employee of any such contractor may, for the purpose of removing the contents of any such receptacle, enter upon any premises or land at any time specified by the Commission.
1.1. A person shall not, by any act or omission, hinder or obstruct Hindering
any servant or employee of the Commission, or any contractor or servant contractor,
or employee of a contractor with the Commission, in the exercise of his •
powers or duties in connexion with the collection or removal of garbage.
12. (1) The garbage removed by the Commission from premises Disposal of
or land in pursuance of these Eegulations shall be the property of the
Commission.
(2) The Commission may sell or dispose of the garbage as it thinks
fit.
13. Notwithstanding anything contained in these Eegulations, the Garbage may 6

14. Any person who contravenes or fails to comply with any Penalty for
provision of these Eegulations shall be guilty of a breach of these Eegulations, and shall upon summary conviction be liable (where no other penalty is provided by these Eegulations) to a penalty not exceeding Twenty pounds, or, where the breach is constituted by a failure to comply with any notice, requisition, direction or order lawfully given under these Eegulations, to a penalty not exceeding One pound for each day during which the breach continues, unless it i3 proved that all due diligence has been used to comply with the notice, requisition, direction or order.
