Gapes v State of Queensland

Case

GAPES

v

STATE OF QUEENSLAND

[2023] HCASL 168
B44/2023

  1. The applicant requires an extension of time in which to seek special leave to appeal from a judgment of the Court of Appeal of the Supreme Court of Queensland (Bond JA, Henry and Wilson JJ) refusing the applicant's applications, including for leave to appeal. The application raises no question of principle suitable for an appeal to this Court nor does it identify any reason to doubt the correctness of the decision of the Court of Appeal. It would therefore be futile to grant an extension of time. The application should be dismissed.

  2. Pursuant to r 41.08.1 of the High Court Rules 2004 (Cth), we direct the Registrar to draw up, sign and seal an order dismissing the application.
