Gaming Machine Regulations2 (Amendment)

The Australian Capital Territory Executive hereby makes the following Regulations under the Gaming Machine Act 1975.

Commencement

1.  These Regulations commence on 1 January 1991.

Principal Regulations

2. In these Regulations, “Principal Regulations” means the Gaming Machine Regulations.

Conduct of ballots

3.  Regulation 5 of the Principal Regulations is amended by adding at the end the following subregulation:

“(2)  The Commissioner may discharge his or her responsibilities in relation to the conduct of a ballot referred to in subregulation (1) through an officer duly authorised for that purpose by the Commissioner.”.

Further amendments

4.  The Principal Regulations are amended as set out in the Schedule.

Regulation 7—

Omit “Authority”, substitute “Commissioner”.

Schedule 1 (Clause 1)—

Omit “Where the Registrar receives from the Authority a request from the Authority a request for the conduct of a ballot the Registrar”, substitute “For the purposes of conducting a ballot, the Commissioner”.

Schedule 1 (Subclause 2 (3))—

Omit “Where the Registrar has received from the Authority a request for the conduct of a ballot, the Registrar”, substitute “For the purposes of conducting a ballot, the Commissioner”.

Schedule 1 (Paragraph 2 (3) (a))—

Omit.

Schedule 1 (Clause 11)—

Omit “the members of the Authority and”.

Schedule 1 (Further amendments)—

The following provisions are amended by omitting “Registrar” (wherever occurring) and substituting “Commissioner”:

Subclause 1 (b); clause 2; subclauses 3 (4), and (5); clauses 4, 6, 7, 8, 9, 10, 11, 12, 13 and 14.

Schedule 1 (Subclause 1 (1))—

Omit paragraphs (a) and (b), substitute “a newspaper published and circulating in the Territory”.

Schedule 2 (Subclauses 1 (1) and 3 (1))—

Omit “Registrar”, substitute “Commissioner”.

Schedule 2 (Subclauses 1 (1) and (2); 3 (2) and (3) and clause 4)—

Omit “Authority”, substitute “Commissioner”.
