3 Gaming Machine Amendment (No. 2) No. 418, 1993 ˙ Short title 1. This regulation may be cited as the Gaming Machine Amendment Regulation (No. 2) 1993 . ˙ Commencement 2. This regulation commences on 1 December 1993. ˙ Amended regulation 3. The Gaming Machine Regulation 1991 is amended as set out in this regulation. ˙ Amendment of s.4 (Interpretation) 4. Section 4(2)(a)— omit, insert— ‘ (a) Category (1)—licensed premises for which a general liquor licence, or an on-premises licence under the Liquor Act 1992 , is in force; ’. ˙ Amendment of s.13 (Installation of gaming equipment) 5. Section 13(b)— omit, insert— ‘ (b) unrestricted access to fire exits in a way that complies with the Fire Service Act 1990 , the Building Act 1975 and the BuildingCode of Australia; ’. ˙ Amendment of s.16 (Machine managers to produce licence or identification etc.) 6. Section 16(2) and (4)— omit ‘ authorised ’, insert ‘ employed ’.
4 Gaming Machine Amendment (No. 2) No. 418, 1993 ˙ Amendment of s.29 (Money clearances) 7.(1) Section 29(2) and (3)— omit ‘ Cash Clearance ’, insert ‘ Cash Clearances ’. (2) After section 29(3) (before penalty provision)— insert— ‘(4) A licensee must ensure that the Cash Clearances Report is completed for each money clearance immediately after subsection (3) has been complied with. ’. ˙ Amendment of s.30 (Manual Payments Register) 8.(1) Section 30(2)(b)— insert— ‘ (iiia) the betting unit; and ’. (2) Section 30(3)— omit, insert— ‘(3) A licensee must ensure that— (a) a hopper fill is performed only when a hopper is empty; and (b) when a hopper fill is performed, the exact number of gaming tokens decided by the Director for the game of the gaming machine are placed in the hopper; and (c) the gaming tokens are of the denomination or type displayed on the gaming machine as a gaming token to be used to operate or gain credit on the gaming machine. ’. (3) After section 30(4) (before penalty provision)— insert— ‘(5) A licensee must ensure records made for subsection (2)(b) or (c) are made immediately each short pay correction payout, hopper fill, jackpot payout or cancelled credit is performed. ’.
5 Gaming Machine Amendment (No. 2) No. 418, 1993 ˙ Amendment of s.31 (Gaming Machine Performance Record) 9.(1) Section 31(2)(a)(ii) and (2)(b)(ii)— omit ‘ or gaming token denomination ’, insert ‘ , gaming token denomination or betting unit ’. (2) Section 31(3)(b)(iv)— omit ‘ gaming token denomination ’, insert ‘ gaming token denomination and betting unit ’. (3) Section 31(3)(b)— insert— w ‘ (xhiein) meter readings are taken under section 28(1)(d) or 33(2), the amounts (in Australian currency) displayed on the progressive jackpot prize meter (if any) on the outside of the gaming machine; and ’. ˙ Amendment of s.32 (Alterations or obliterations to records) 10. Section 32(1)— omit ‘ Cash Clearance ’, insert ‘ Cash Clearances ’. ˙ Amendment of s.33 (Installation, removal and alteration of gaming machines) 11. Section 33(1)(a) and (2)(b)— omit ‘ or gaming token denomination ’, insert ‘ , gaming token denomination or betting unit ’. ˙ Amendment of s.35A (Accounts with financial institutions) 12. Section 35A(6)— renumber as section 35A(5).

Section 35B(2) (definition “gaming records” )— omit ‘ records ’, insert ‘ cheques ’. ˙ Amendment of s.37 (Daily rental fees) 14. Section 37(3) (in Column 2 of the Table opposite Category 1 in Column 1)— omit ‘ Rate 1 ’, insert ‘ Rate 3 ’. ˙ Amendment of s.38 (Day prescribed) 15. Section 38 (after ‘ 8.5(2), ’ )— insert ‘ 8.5A(2), ’ ˙ Amendment of s.41 (Charities and rehabilitation levy) 16. Section 41(a)— omit ‘ 4.5% ’, insert ‘ 4.0% ’. ˙ Insertion of new s.41A 17. After section 41— insert— ˙ ‘Gaming Machine Community Benefit Levy ‘41A. Under section 8.5A(3) of the Act, the prescribed percentage is— (a) for Category 1 licensed premises—0.5%; and (b) for Category 2 licensed premises for December 1993 and January 1994—Nil%; and (c) for Category 2 licensed premises for the months after January 1994—

Section 43(e)— omit, insert— ‘ (e) fifthly—gaming machine community benefit levies; (f) sixthly—penalties under section 8.7(1)(a) of the Act’. ˙ Amendment of Schedule 1 (Prescribed bodies and authorities) 19.(1) Schedule 1— omit ‘ Independent Victorian Gaming Commission ’ and ‘ Northern Territory Racing, Gaming and Liquor Commission ’. (2) Schedule 1— insert— ‘ Federal Airports Corporation Northern Territory Racing and Gaming Authority Office of Consumer Affairs, Queensland Office of the Liquor Licensing Commissioner, South Australia Victorian Gaming Commission ’.
8 Gaming Machine Amendment (No. 2) No. 418, 1993 ˙ Amendment of Schedule 2 (Conditions to which a gaming machine licence is subject) 20.(1) Schedule 2, clause 1(a)— omit, insert— ‘ (a) subject to section 3.17 of the Act, have installed on the licensee’s licensed premises, within 6 months after being granted a gaming machine licence, the gaming machines provided by the Director under section 3.14 of the Act, unless the machines cannot be installed because of the Director’s fault; and (aa) care for all gaming machines (and ancillary or related property of the State), on the licensee’s licensed premises, in the way a reasonable, careful and prudent owner would; and ’. (2) Schedule 2, clause 1(e)— omit, insert— ‘ (e) ensure a common key to locks used for each purpose mentioned in paragraph (d) is exclusive to the locks; and ’. (3) Schedule 2, clause 1(i)(ii)— omit ‘ transporting ’, insert ‘ removing and transporting ’. (4) Schedule 2, clause 1(i)(iii)— omit ‘ or gaming token denomination ’, insert ‘ , gaming token denomination or betting unit ’. (5) Schedule 2, clause 1(i)(iiia)— omit ‘ , or removing ’, and ‘ under section 3.15(1) of the Act ’. (6) Schedule 2, clause 1(i)(vi)— omit, insert— ‘ (vi) of investigating and correcting errors or omissions in, or the preparation of, a Monthly Gaming Machine Reconciliation Report lodged by the licensee under section 7.4 of the Act; and ’. (7) Schedule 2, clause 1(j)— omit ‘ the issue of the licence ’,

(8) Schedule 2, clause 1(k)(i) and (ii)— omit, insert— ‘ (i) the start of gaming on the machines provided because of the original approval for the licensed premises; or (ii) the start of gaming on the additional gaming machines provided to the licensee after the licensee is granted an increase in the number of machines provided to the licensee; ’. ˙ Amendment of Schedule 3 (Director’s obligations to a licensee) 21.
