GAMING AND BETTING
(REDUCTION OF RACING DAYS)
AMENDMENT ACT.
Act No. 46, 1932.
An Act to reduce the number of days upon which race-meetings may lawfully be held upon certain racecourses; to amend the Gaming and Betting Act, 1912-1931; and for pur poses connected therewith. [Assented to, 21st December, 1932.]

Schedule
2 . The P r inc ipa l Act is amended—
(a) (i) by omit t ing subsection th ree of section
fifty-one and by inser t ing in lieu thereof the
following subsect ion:— (3) Subject to the provis ions of th is Act the max imum number of days in any one yea r on which meet ings for horse- rac ing m a y be held shall be as fol lows:—
(a) on the whole of the licensed race
courses ment ioned in the F o u r t h Schedule to th is Act the max imum number of days shall be fifty-seven, four of which days shall be Wednes days , forty-seven of which days shall be S a t u r d a y s (including E a s t e r
S a t u r d a y ) , and six of which days shall be public holidays.
The max imum number of days in any one yea r on which meetings m a y be held on each of those racecourses shall be the number set opposi te the name of the racecourse in the said Schedule :
P rov ided tha t the Governor m a y allow Randwick Racecourse an addi tional race meet ing on any addi t ional public hol iday which is proclaimed upon a special occasion;
(b) where the racecourse is situated within for ty miles of the pr inc ipa l pos t office, Newcastle, the number of days on which meet ings m a y he held in any one year shall be fifteen or the number of days on which such meet ings were held on such racecourse dur ing the twelve months ending on the thirty-first day of Ju ly , one
thousand nine hundred and six, whichever number is the smal le r :
P rov ided tha t a meet ing may be
held on any such racecourse on a t
least seven days in any one year .The Governor if satisfied t h a t in any y e a r one or more days available for meet ings for horse-racing on a n y of such racecourses will not be used for tha t purpose , may by proclama t ion allow the Newcastle Jockey Club Limited to hold a meet ing or meet ings for horse-racing on such day o r days on its racecourse a t Hami l ton ,
but
but not more than ten of such addi t ional meeting's in all shall be so allowed in any one y e a r ;
(c) where the racecourse is situated or is deemed to be beyond for ty miles of "the General P o s t Office, Sydney, and is within sixty-five miles of tha t pos t office, the number shall be twelve ; (ii) by omitting from subsection (3A) of the same section the words " provided tha t the number of days in any one yea r on which meet ings for horse-racing may be held on the said racecourse shall not exceed six
teen ' ' ; (iii) by omitting subsection four of the same section and by inser t ing in lieu thereof the
following subsect ion:— (4) Subject to the provis ions of th is Act the max imum number of days in any one yea r on which meet ings for pony-rac ing may be held shall be as fol lows:—
(a)
on the licensed racecourses mentioned in the F i f th Schedule to this Act the max imum number of days shall be fifty-four, forty-eight of which days shall be Wednesdays, five of which days shall be S a t u r d a y s , and one of
which days shall be the first Monday
in Augus t . The max imum number of days in any one yea r on which meet ings may be held on each of those racecourses shall be the number set opposite the name of the racecourse in the said Schedule ;
(b) where the racecourse is s i tuated beyond for ty miles of the General P o s t Office, Sydney, the number shall be six;
(iv),
(iv) by omitting from subsection five of the same section the words " which days may be other t han Wednesdays or S a t u r d a y s " ;

| (ii) | by omitting from the same subsection the words ' ' and three o f ' ' where firstly occur r ing and by inser t ing in lieu thereof the words ' ' and two of " ; |
(c) (i) by inser t ing a t the commencement of sec
t ion fifty-three the following words :—
' ' Race-meetings for t ro t t ing races or con tests on racecourses s i tuated within for ty miles of the General P o s t Office, Sydney, may be held on Mondays, Tuesdays , Thurs days or F r i d a y s except on Good F r iday , Chr i s tmas Day, or other public ho l idays ;
other " ;
( i i ) by inser t ing in section fifty-three af ter the
words " on no other days " the words " but where a public holiday falls upon a Wednes d a y or upon a S a t u r d a y a race-meeting may be held upon any other day in tha t week not being Sunday, Good F r i d a y or Chr is tmas D a y ; and where there a re , in any one year , fifty-three Sa tu rdays , a race-meeting m a y be held on one S a t u r d a y in lieu of a race- meet ing which would in a year in which the re are fifty-two S a t u r d a y s be required to be held upon a Wednesday , and when in any yea r Chr i s tmas D a y falls upon a Sunday a race-meeting may be held on the public holiday falling on the Tuesday fol lowing in lieu of upon the Wednesday of
t ha t week; (iii) by omitting from the same section the
words " within one week of such postpone ment " and by inser t ing in lieu thereof the words " (not being Sunday, Good F r iday , Chr is tmas Day, or a day a l ready appropr i a t ed and notified as a day of rac ing
(by).
by any o ther club in the same d i s t r i c t ) within fourteen days of such postpone ment
(d) by inser t ing next af ter section fifty-three t h e following new sect ions:—
53A. W h e r e any licensed racecourse is tempor ar i ly rendered unfit for use as a racecourse t h e Minis ter may, upon the prescr ibed applicat ion, au thor ise a race-meet ing appoin ted for t ha t racecourse to be held upon any other racecourse, wi th the consent of the owner, lessee or t ru s t ee
thereof, and for the purposes of the computat ion of the number of meet ings allowed u n d e r th is Act the meet ing shall be deemed to h a v e been held upon the racecourse t empora r i ly unfit for use.
53B. I n the event of any of the racecourses specified in the F o u r t h Schedule or the F i f t h Schedule to this Act ceasing to be licensed the days allotted to such racecourse by this Act shall be divided among the other licensed race courses ment ioned in the same Schedule in such a manne r as may be agreed upon by the owners, lessees, or t rus tees thereof, approved by the Minis ter and notified in the Gazette, or, in t h e event of d isagreement , they shal l be divided among the other racecourses ment ioned in t h e same Schedule in such a m a n n e r as the Gov ernor directs and notifies in the Gazet te .
(e) by inse r t ing next af ter the T h i r d Schedule t h e
