Act No. 45, 1989

An Act to amend the Gaming and Betting Act 1912 with respect to the licensing year for race-courses and the days of race-meetings. [Assented to 15 May 1989]

Gaming and Betting (Racing) Amendment 1989

The Legislature of New South Wales enacts:

Short title

1. This Act may be cited as the Gaming and Betting (Racing)

Amendment Act 1989.

Commencement

2.     This Act commences on the date of assent.

Amendment of Gaming and Betting Act 1912 No. 25

  1. The Gaming and Betting Act 1912 is amended as set out in Schedule

1.

Transitional

4.     (1) A licence under section 51 of the Gaming and Betting Act 1912

issued for the year commencing 1 January 1989—

(a) shall be taken to be issued for the period commencing 1 January 1989 and ending 30 June 1989; and
(b) if the appropriate fees are paid on or before 1 July 1989, shall be taken to be issued for the year commencing 1 July 1989.

(2) The maximum number of days on which race-meetings may be held on a race-course licensed (under a licence taken to be issued as referred to in subsection (1) (b)) in the period commencing 1 January 1989 and ending 31 December 1989 is the number of days on which race-meetings could have been held had this Act not been enacted.

SCHEDULE 1—AMENDMENTS

(Sec. 3)

(1) Section 51 (Restrictions on race-meetings and harness racing)

Section 51 (7)—

Omit "January", insert instead "July".

(2) Section 52 (Issue of licences)

Section 52 (2), (2A)—

Omit "January" wherever occurring, insert instead "July".

(3) Section 53 (Days of race-meetings)

(a) Section 53 (3)—

(c)

Section 53 (7) (b), (c)— Omit the paragraphs, insert instead:

(b) on Monday, Tuesday, Thursday or Friday of the week in which that Wednesday falls.
