AMENDMENT ACT, 1979, No. 197

Act No. 197, 1979.

An Act to amend section 53 of the Gaming and Betting Act, 1912, to permit meetings for horse-racing at certain race-courses to be held on certain days approved by the Minister. [Assented to, 21st December, 1979.]

BE it enacted by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Council and Legislative Assembly of New South Wales in Parliament assembled, and by the authority of the same, as follows :—

1. This Act may be cited as the "Gaming and Betting

(Race-meetings) Amendment Act, 1979".

2.      (1) This Act, other than section 3, shall commence on the

date of assent to this Act.

(2) Section 3 shall commence on such day as may be appointed by the Governor in respect thereof and as may be notified by proclamation published in the Gazette.

3.      The Gaming and Betting Act, 1912, is amended—

(a) by omitting section 53 (1) and by inserting instead the following subsections :—

(1) Meetings for horse-racing at race-courses situated within 64 kilometres of the General Post Office, Sydney, may, subject to this Act, be held only—

(a) on Wednesdays and Saturdays;
(b) on public holidays, including the first Monday in August;
(c) where a public holiday falls upon a Wednesday or a Saturday, on any other day of the week in which that Saturday or Wednesday falls or in the next succeeding week;
(d) where in any year Christmas Day falls upon a Sunday, on the public holiday falling on the Tuesday following instead of upon the Wednesday of that week; and

(e)

where the Minister so approves, in writing, in relation to a race-course so situated and specified in his approval, on such other days, being Mondays, Tuesdays, Thursdays or Fridays, as may be so specified.

(1A) Nothing in subsection (1) enables a meeting referred to in that subsection to be held on a Sunday, Good Friday or Christmas Day.

(b) by omitting section 53 (5); (c) by omitting section 53 (8).

Except in so far as the Minister otherwise approves under section 53 (1) (e) of the Gaming and Betting Act, 1912, as amended by this Act, nothing in this Act affects an approval of the Minister under section 53 (8) of that Act, being an approval in force immediately before the day appointed and notified under section 2 (2) of this Act.
