Act No. 121,1983.

An Act to amend the Gaming and Betting Act, 1912, to increase the penalties

for certain offences under that Act relating to betting, and for other

purposes. [Assented to, 15th December, 1983.]

   Gaming and Betting (Penalties) Amendment.

BE it enacted by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Council and Legislative Assembly of New South Wales in Parliament assembled, and by the authority of the same, as follows:—

Short title.

1. This Act may be cited as the "Gaming and Betting (Penalties)

Amendment Act, 1983".

Amendment of Act No. 25, 1912.

2. The Gaming and Betting Act, 1912, is amended in the manner set

forth in Schedule 1.

SCHEDULE 1.

(Sec. 2.)

AMENDMENTS TO THE GAMING AND BETTING ACT, 1912.

(1) (a) Section 5—

Omit "$1,000", insert instead "$5,000".

(b) Section 5—

Omit "The form", insert instead "(2) The form".

(c) Section 5 (3 )—

At the end of section 5, insert:—

(3) Where a member of the police force arrests any such person, bookmaker, agent, clerk or servant for an offence against this section—

(a) that member of the police force may seize—

(i) any money or valuable thing; and

(ii) any list, card or other document or thing,

which that member of the police force suspects or believes was used in or otherwise connected with the commission of the offence; and

(b) upon conviction, any money, valuable thing, list, card, document or thing so seized shall, unless the court is satisfied that there are no reasonable grounds for that suspicion or belief, be forfeited to Her Majesty.

(2) Section 44 (1 )—

Omit "$1,000", insert instead "$5,000".
