GAMING AND BETTING (FURTHER

Act No. 60, 1977.
An Act to amend the Gaming and Betting Act, 1912, in relation to restrictions on meetings for horse-racing. [Assented to, 6th September, 1977.]

BE it enacted by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Council and Legislative Assembly of New South Wales in Parliament assembled, and by the authority of the same, as follows :—
1. This Act may be cited as the "Gaming and Betting (Further Amendment) Act, 1977".
(1) Except as provided in subsection (2) , this Act shall commence on the date of assent to this Act.

(2) If the date of assent to this Act is later than 22nd September, 1977, section 4, in its application to Schedule 1 (2), and Schedule 1 (2) shall be deemed to have commenced on 22nd September, 1977.
This Act contains the following Schedules :—
SCHEDULE 1.—AMENDMENTS TO THE GAMING AND
BETTING ACT, 1912, RELATING TO RESTRICTIONS

SCHEDULE 2.—AMENDMENTS TO THE GAMING AND
BETTING ACT, 1912, BY WAY OF STATUTE LAW

The Gaming and Betting Act, 1912, is amended in the manner set forth in Schedules 1 and 2.

S C H E D U L E 1.
AMENDMENTS TO THE GAMING AND BETTING ACT, 1 9 1 2 ,
RELATING TO RESTRICTIONS ON RACE MEETINGS.
( 1 ) Section 53 ( 4 ) — Omit "foregoing".
(2) (a) Section 53 (5) (b )—
Omit "1977,", insert instead "1977; and".
(b) Section 53 (5) (c )—
After section 53 (5) (b), insert:—

at Randwick Race-course on Thursday, 22nd September, 1977,
(3) Section 53 (6) , (7) , (8 )—
After section 53 (5), insert:—
(6) In the year commencing on 1st January, 1978, and in any subsequent year, dates for horse-racing shall be allotted so that—
(a) a meeting for horse-racing may be held at
the race-course of the Newcastle Jockey Club Limited at Hamilton on each of 2 free Wednesdays that are not free Wednesdays referred to in paragraph (b) ; and
(b)
a meeting for horse-racing may be held on one free Wednesday at Hawkesbury Race- course, on another free Wednesday at Wyong Race-course and on another free Wednesday at Gosford Race-course,
unless in any case the club concerned agrees to forego
its right to hold the meeting on a free Wednesday.

(7) For the purposes of subsection (6) , a meeting for horse-racing is held at a race-course on a free Wednesday if no meeting for horse-racing may be held at any other race-course situated within 64 kilometres of the General Post Office, Sydney—
(a) on that Wednesday;
(b) on Monday or Tuesday of the week in which that Wednesday falls; or
(c) unless it is a postponed race-meeting under subsection (3) , on Thursday or Friday of that week.
(8) Where subsection (6) operates to reduce the maximum number of meetings for horse-racing that, if that subsection had not been enacted, could have been held during a year referred to in that subsection at race-courses situated within 64 kilometres of the General Post Office, Sydney, such number of meetings for horse-racing may be held at those race-courses on
days approved by the Minister (not being a Sunday, Good Friday or Christmas Day) as will provide for attainment of that maximum number. SCHEDULE 2.
AMENDMENTS TO THE GAMING AND BETTING ACT, 1912, BY WAY OF STATUTE LAW REVISION.
(1) Section 1—
Omit the matter relating to Part I V , insert instead :—

(2) Section 51, heading—
Omit the heading.
(3) Section 50s—
Before section 51, insert:—
50s. For the purposes of this Part, the Menangle Park Race-course and the Hawkesbury Race-course shall be deemed to be situated beyond 64 kilometres from the General Post Office, Sydney.
(4) (a) Section 51 (3), (3A), ( 3 B ) — Omit section 51 (3) and (3A), insert instead :— (3) Subject to this Act, the maximum number of days in any one year on which meetings for horse-racing (not being barrier trial meetings) may be held shall be—
(a)
on a race-course specified in column 1 of the Fourth Schedule, the number of days set out opposite that race-course in column 2 of that Schedule;

(b) 32 days on the race-course of the Newcastle Jockey Club Limited at Hamilton, 11 days on Cessnock Race course and 15 days in the case of any other race-course situated within 64 kilometres of the principal post office, Newcastle; and
(c) 15 days on any race-course situated beyond 64 kilometres of the General Post Office, Sydney, and within 104 kilometres of that post office.
(3A) The Minister may, on the request of the
Australian Jockey Club—
(a)
allow an additional meeting for horse- racing at Randwick Race-course on any additional public holiday which is proclaimed upon a special occasion;
(b) notwithstanding section 53 (1), allow
at Randwick Race-course on the day an additional meeting for horse-racing on which the race known as the Melbourne Cup is to be held; and (c) adjust, from time to time, the maximum number of days on which meetings for horse-racing may be held on Randwick Race-course and Warwick Farm Race-course pursuant SCHEDULE 2—continued.

to this Act by increasing the maximum number of days on which meetings may be held on one of those race courses and by reducing to a corres ponding extent the maximum number of days on which meetings may be held on the other of those race-courses.
(3B) The Minister may, on the request of the Sydney Turf Club, adjust, from time to time, the maximum number of days on which meetings for horse-racing may be held on Rosehill Race-course and Canterbury Race-course pursuant to this Act by increasing the maximum number of days on which meetings may be held on one of those race-courses and by reducing to a corresponding extent the maximum number of days on which meetings may be held on the other of those race-courses.
(b) Section 5 1 ( 4 ) ( a )—
Omit the paragraph.
(c) Section 5 1 ( 4 A ) , ( 5 A ) —
Omit the subsections.
( 5 ) (a) Section 5 3 ( 1 ) — After "public holidays", insert "(including the first Monday in August)".
