Games, Wagers and Betting-houses (Amendment) Ordinance 1986

I, THE GOVERNOR-GENERAL of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Ordinance under the Seat of Government (Administration) Act 1910.

An Ordinance relating to gaming, wagering and suppression of betting-houses
Short title
1. This Ordinance may be cited as the Games, Wagers and Betting-houses (Amendment) Ordinance 1986.1
Interpretation
2. In this Ordinance, “the Act” means the Games Wagers and Betting-houses Act 1901 of the State of New South Wales in its application to the Territory.
Search under special warrant
3. Section 4 of the Act is amended by omitting from sub-section (2) “if necessary obtain assistance and use force whether by breaking open doors or otherwise” and substituting “obtain such assistance and use such force as is necessary and reasonable”.
Search of premises under special warrant
4. Section 15 of the Act is amended by omitting from sub-section (2) “if necessary obtain assistance and use force by breaking open doors or otherwise” and substituting “obtain such assistance and use such force as is necessary and reasonable”.
Deputy Commissioner of Police may authorize entry of premises
5. Section 16 of the Act is amended—
(a)by omitting “if necessary to use force” and substituting “to obtain such assistance and use such force as is necessary and reasonable”; and
(b)by omitting “whether by breaking open doors or otherwise”.
