Games, Wagers and Betting-houses Ordinance

I, THE GOVERNOR-GENERAL of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following

Ordinance under the Seat of Government (Administration) Act 1910.

An Ordinance relating to gaming, wagering and the suppressing of

betting-houses

Short title

1. This Ordinance may be cited as the Games, Wagers and Betting-houses

Ordinance 1982.1

Interpretation

2. In this Ordinance, "the Games Wagers and Betting-houses Act" means the Games Wagers and Betting-houses Act 1901 of the State of New South Wales, in its application to the Territory.

(b) by omitting the proviso.

Short title

3. Section 1 of the Games Wagers and Betting-houses Act is amended-

(a) by omitting "PART II .—GAMING AND WAGERING.—ss.
4 - 1 3 . " a n d s u b s t i t u t i n g " P A R T I I . — G A M I N G A N D

WAGERING.—ss. 4-13A."; and

(b) by omitting "Avoidance of contracts—s. 13." and substituting

'Avoidance of contracts—5X 13,13A.".

Actions not to lie for contracts by way of gaming

4. Section 13 of the Games Wagers and Betting-houses Act is amended—

(a)

by omitting "All contracts" and substituting "Subject to section 13A, all contracts"; and

5. After section 13 of the Games Wagers and Betting-houses Act the

following section is inserted in Part II:

Application

" 1 3A. This Act does not apply to, or in relation to—

(a)

a subscription or contribution, or a contract or agreement to subscribe or contribute, for or toward any plate, prize or sum of money to be awarded to the winner of any lawful game, sport, pastime or exercise;

(b)

a bet or wager lawfully made with a bookmaker, in the course of carrying on his business as a bookmaker, on a racecourse in respect of which a licence is issued and in force under the Racecourses Ordinance 1935;or

(c)

any other bet or wager lawfully made in relation to any lawful game, sport, pastime or exercise.".
