GAMES, WAGERS AND BETTING-HOUSES

No. 17 of 1964.

An Ordinance relating to Gaming, Wagering and

Suppressing of Betting-houses.

Short title. 1. This Ordinance may be cited as the Games, Wagers and

Betting-houses Ordinance 1964.*

Commence-	2. This Ordinance shall come into operation on the first day of September, One thousand nine hundred and sixty-four.
Definition.	3 . In this Ordinance " the Games Wagers and Betting- houses Act 1901 " means the Games Wagers and Betting-houses Act 1901 of the State of New South Wales in its application to the Territory as amended by the Gaming and Betting Act, 1906 of that State in its application to the Territory.

Amendment of	4. Section seventeen of the Games Wagers and Betting-

Act 1901.	(a) by inserting in sub-section (1) (first occurring), after the word " telegram", the words " or telephone ";
(b) by adding at the end of that sub-section the words " or communication "; and
(c) by adding at the end of that section the following

sub-section:—

commenced on 1 September 1964 (see section 2).

" (3.) A house, office, room or other place shall be deemed not to be opened, kept or used for a purpose mentioned in section seventeen of this Act if it is opened, kept or used for the purpose of determining, negotiating, accepting, distribut- ing or settling bets made through the Australian Capital Territory Totalizator Agency Board under the Betting (Off-course Totalizator Agency) Ordinance 1964 or for determining, negotiating, receiving, paying or settling entries or stakes in a pool betting competition or trans- action within a pool betting scheme approved under the Pool Betting Ordinance 1964.".

5. After section seventeen of the Games Wagers and

Betting-houses Act 1901 the following section is inserted:—

" 17A.—(1.) A person who is guilty of an offence against Penaiticfor

this Part is liable upon conviction—	Partm.

(a) for a first offence—to a fine of not less than One hundred pounds or more than Two hundred pounds, or to imprisonment for not more than three months;

(b) for a second offence—to a fine of not less than Two hundred pounds or more than Five hundred pounds, or to imprisonment for not more than three months; and

(c) for a subsequent offence—to imprisonment for not less than three months or more than six months.

" (2.) For the purposes of the application of paragraphs (a), (b) and (c) of the last preceding sub-section, all offences committed by a person on the one day shall be deemed to be the one offence, but separate penalties may be imposed in respect of each of those offences in accordance with whichever of those paragraphs is applicable.".

6. Section nineteen of the Games Wagers and Betting- Offence of keeping a

(b) by omitting from sub-section (2) the words

7. Section twenty of the Games Wagers and Betting-houses offence of

Act 1901 is amended by omitting all the words after the words asXp'raitTtoT

8. Section twenty-one of the Games Wagers and Betting-
