Regulation under the Game and Feral Animal Control Act 2002.

Explanatory note

The object of this Regulation is to extend, by 1 month, the period for which a current restricted game hunting licence remains in force. The extension applies only if the holder of the licence held a restricted game hunting licence in force at any time between 6 April 2020 and 6 May 2020, during which time permission to hunt game animals in State forests was not given because of the COVID-19 pandemic.

This Regulation also allows game hunting licences to be granted for any period up to a maximum of 5 years, rather than only for specified periods of 1, 2, 3, 4 or 5 years, and makes a consequential amendment to the fees payable in respect of game hunting licence applications.

This Regulation is made under the Game and Feral Animal Control Act 2002, including sections 25(2)(b),
32 and 60 (the general regulation-making power).

1      Name of Regulation

This Regulation is the Game and Feral Animal Control Amendment (COVID-19

Extension of Licences) Regulation 2020.

2      Commencement

This Regulation commences on the day on which it is published on the NSW legislation website.

[1]      Clause 15

Omit clauses 15 and 15A. Insert instead—

15 Maximum duration of licences

For the purposes of section 25 of the Act, the relevant maximum period for a game hunting licence is 5 years.

[2]      Clause 16 Licence fees

Omit clause 16(1). Insert instead—

The fee payable in respect of an application for a licence of a type specified in Column 1 of the following table is, according to the duration of the licence, the corresponding fee specified in Column 2, 3, 4, 5 or 6.

22B COVID-19 pandemic—extension of duration of licences

A restricted game hunting licence in force immediately before the commencement of this clause remains in force for an additional month, starting on the day after the day on which the licence is due to expire, if the holder of the licence held a restricted game hunting licence in force at any time between the start of 6 April 2020 and the end of 6 May 2020.
