An Act to amend the Game and Feral Animal Control Act 2002 with respect to the functions of the Game Council and the application of penalties for offences under that Act.

1Name of Act

This Act is the Game and Feral Animal Control Amendment Act 2005.

2Commencement

This Act commences on the date of assent to this Act.

3Amendment of Game and Feral Animal Control Act 2002 No 64

The Game and Feral Animal Control Act 2002 is amended as set out in Schedule 1.

Schedule 1Amendments

(Section 3)

[1]Section 9 Functions of Game Council

Insert after section 9 (1) (f):

  • (f1)

    to promote, fund, develop or deliver educational courses regarding game animals and animals that interact with game animals,

  • (f2)

    to promote or fund research into issues regarding animals that interact with game animals,

  • [2]Section 13 Financial provisions

    Insert at the end of section 13 (2) (c):

  • , and

  • (d)

    the amount of any fines, or amounts payable under penalty notices, recovered in relation to offences against this Act or the regulations which, but for this paragraph, would be payable to the Consolidated Fund.

    The amendment made to section 13 by the Game and Feral Animal Control Amendment Act 2005 extends to a fine, or an amount payable under a penalty notice, recovered after the commencement of the amendment, even if the fine was imposed, or the penalty notice was issued, before that commencement.
