Gambling Regulation and Gambling Regulation (Prescribed Connection and Prescribed Profit) Amendment Regulations 2014

The Lieutenant-Governor as the Governor's deputy with the advice of the Executive Council makes the following Regulations:

PART 1—PRELIMINARY

1Objective

The objective of these Regulations is to—

(a)amend the Gambling Regulation Regulations 2005 to prescribe offences under the Gambling Regulation Act 2003, the Gambling Regulation Regulations 2005 and the Casino Control Act 1991 in respect of which an infringement notice may be issued and to prescribe infringement penalties for those offences; and

(b)amend the Gambling Regulation (Prescribed Connection and Prescribed Profit) Regulations 2009 to reflect the repeal of section 3.2A.1 of the Gambling Regulation Act 2003.

2Authorising provision

These Regulations are made under section 11.2.1 of the Gambling Regulation Act 2003.

PART 2—AMENDMENT OF THE GAMBLING REGULATION REGULATIONS 2005

3New Part 11 inserted

After regulation 108 of the Gambling Regulation Regulations 2005[1] insert—

PART 11—INFRINGEMENT OFFENCES

109Infringement offences

(1)For the purpose of section 10.5.20(1) of the Gambling Regulation Act 2003, an offence against a provision of an Act or the regulations set out in Column 2 of Schedule 5 is prescribed as an offence in respect of which an infringement notice may be issued.

(2)For the purpose of section 10.5.21 of the Gambling Regulation Act 2003, the prescribed infringement penalty for an offence against a provision of an Act or the regulations set out in Column 2 of Schedule 5 is the relevant amount set out in Column 3 of Schedule 5 in respect of an offence.".

4New Schedule 5 inserted

After Schedule 4 to the Gambling Regulation Regulations 2005 insert—

5Prescribed interests

In regulation 7 of the Gambling Regulation (Prescribed Connection and Prescribed Profit) Regulations 2009[2], for "section 3.2A.1 of the Act" substitute "section 1.3(1) of the Act".
