1. The applicant seeks an extension of time within which to seek special leave to appeal a decision of the New South Wales Court of Criminal Appeal (Hoeben CJ at CL, RA Hulme and Davies JJ agreeing).

2. Though we would grant the extension of time, there is no reason to doubt the correctness of the Court of Criminal Appeal's decision, having regard to the way in which issue was joined at trial.

3. Pursuant to r 41.08.1 of the High Court Rules 2004 (Cth), we direct the Registrar to draw up, sign and seal an order dismissing the application.
