HER HONOUR:   Mr Gajic, I understand you want to dismiss the summons seeking a stay?

MR GAJIC:   Yes, withdraw the summons, yes.

HER HONOUR:   And you seek an order that the costs in respect of the summons be the costs in the application for special leave?

MR GAJIC:   Yes, your Honour.

HER HONOUR:   Yes.  Is there anybody present to represent Mr Poyser?

MR GAJIC:   No, your Honour.

HER HONOUR:   We should have the matter called, Deputy Registrar.

This is the hearing of a summons filed on 14 September 2007 by the applicant seeking certain orders.  There has been no appearance today for the respondent.  The orders sought by the applicant are:

1.the abovementioned summons which is set down for hearing on 21 November 2007 be dismissed;  and

2.the costs in respect of the summons be costs in the application for special leave.
