1. The applicants seek special leave to appeal from part of the judgment of the Court of Appeal of the Supreme Court of New South Wales (Kirk JA, Payne JA and Griffiths A-JA agreeing) allowing an appeal from a judgment of the Land and Environment Court of New South Wales (Duggan J).

2. There is insufficient reason to doubt the correctness of the outcome of the Court of Appeal's decision to warrant a grant of special leave to appeal.

3. Special leave to appeal is refused with costs.
