1Name of Order

This Order is the FuelCheck Order 2016.

2Commencement

This Order commences on the day on which it is published on the NSW legislation website.

3Registration of service station operators(1)

Operators of service stations must register with NSW Fair Trading using the form provided for this purpose on the website at label="(i)">(i)

if they are already in business at the time of this order—by 14 July 2016,

  • (ii)

    otherwise—before they first sell fuel to retail customers.

  • (2)

    Operators must provide the following details:

    • (i)

      Name of legal entity which operates the service station,

    • (ii)

      ABN and ACN for the entity,

    • (iii)

      Trading name for the service station (if any),

    • (iv)

      Fuel brand used at the service station (if any),

    • (v)

      Types of fuel offered for sale at the service station,

    • (vi)

      Address including number, street name and suburb,

    • (vii)

      Telephone number for the service station,

    • (viii)

      Trading hours for the service station,

    • (ix)

      Name of the primary contact person for the service station,

    • (x)

      Position or title of the primary contact person,

    • (xi)

      Mobile telephone number for the primary contact person,

    • (xii)

      Email address for the primary contact person.

    4Notification of standard retail price of fuel

    Operators of service stations must ensure that the Secretary is notified by means of the website at of the standard retail price and the date and time from which the fuel was available at that standard retail price for any of the following fuels offered for sale at the service station:

    • (1)

      Regular unleaded petrol (RON 91),

    • (2)

      E10 (RON 94),

    • (3)

      Premium unleaded petrol labelled RON 95,

    • (4)

      Premium unleaded petrol labelled RON 98,

    • (5)

      E85 (RON 105),

    • (6)

      Diesel,

    • (7)

      Fuel labelled “premium diesel”,

    • (8)

      Liquefied petroleum gas (LPG),

    • (9)

      Compressed natural gas or natural gas for vehicles (CNG or NGV),

    • (10)

      Liquefied natural gas (LNG),

    • (11)

      B20 (biodiesel and diesel).

    Note—

    Standard retail price is defined in section 58 (6) of the Act as the price per litre at which the fuel is available to retail customers without any discounts or special offers.

    Note—

    Failure to register or notify current fuel prices in compliance with this Order is an offence under section 58 (4) of the Act.
