s1 3 s5 Fruit Marketing Organisation Amendment (No. 3) No. 231, 1996 ˙ Short title 1. This regulation may be cited as the Fruit Marketing Organisation Amendment Regulation (No. 3) 1996 . ˙ Regulation amended 2. This regulation amends the Fruit Marketing Organisation Regulation 1964 . ˙ Amendment of s 1 3. Section 1, from ‘shall in’ to ‘year thereafter’— omit, insert— ‘must in November or December 1996 and in November or December of each third following year’. ˙ Amendment of s 10 4. Section 10, first sentence, from ‘who shall’— omit, insert— ‘elected in 1996 and in each third following year.’. ˙ Amendment of s 11 5.(1) Section 11, ‘, Pineapple,’— omit, insert— ‘, heavy produce, tomato,’. (2) Section 11(1)(b)— omit, insert— ‘(b) for the heavy produce sectional group committee, heavy produce produced from land that is— (i) 1 hectare or more; and

(3) Section 11(3)(a), after ‘vegetables’— insert— ‘or heavy produce’. (4) Section 11(3)(b)— omit. (5) Section 11(3)(d), after ‘other fruits’ (first mention)— insert— ‘or tomatoes’. ˙ Amendment of s 13 6.(1) Section 13(1)(b)— omit, insert— ‘(b) for the heavy produce sectional group committee, heavy produce produced from land that is— (i) 5 hectares or more; and (ii) not cropped more than once a year; and (iii) outside the Stanthorpe fruit and vegetable area; or (ba) for the tomato sectional group committee, tomatoes produced from land that is— (i) 2 hectares or more; and (ii) outside the Stanthorpe fruit and vegetable area; or’.

The number of members elected to each sectional group committee is as follows— (a) banana group committee—7; (b) heavy produce group committee—8; (c) tomato group committee—5; (d) citrus group committee—8; (e) deciduous group committee—11; (f) other fruits group committee—9; (g) vegetable group committee—10. ˙ Allocation of local associations to electorates 44. The local associations mentioned in the schedule are allocated to the electorate set out opposite them for electing members to the sectional group committee named in the part of the schedule they are in. ˙ Number of members elected by each electorate 45. The number of sectional group committee members to be elected to represent the electorates numbered in the part of the schedule for each committee is as follows— (a) for the banana, deciduous, other fruits and vegetable group committees—1 member, by each electorate numbered; (b) for the heavy produce group committee— (i) 1 member, by each of electorates 1, 3, 4, 5 and 6; and (ii) 3 members, by electorate 2; (c) for the tomato group committee— (i) 1 member, by electorate 1; and (ii) 2 members, by each of electorates 2 and 3;

Part 2, schedules 1 to 6— omit. ˙ Amendment of s 50 15.(1) Section 50(2)(b)— omit, insert— ‘(b) heavy produce produced from land outside the Stanthorpe fruit and vegetable area that is— (i) 1 hectare or more; and (ii) not cropped more than once a year; or (ba) tomatoes produced from land outside the Stanthorpe fruit and vegetable area that is half a hectare or more; or’. The committee of direction must give a copy of its annual report to each local association. ˙ Definitions 106. In this regulation— “approved form” see section 107. “heavy produce” means garlic, onions, potatoes, pumpkins, sweet potatoes or swede turnips. “the Stanthorpe fruit and vegetable area” means the local government areas of the following shires— (a) Inglewood; (b) Stanthorpe; (c) Warwick, other than the area of the former Shire of Allora, as described in the order in council published in the gazette on 13 November 1954 at page 1281. ˙ Approval of forms 107. The chief executive 1 may approve forms for use under this regulation. ˙ Transitionally approved forms 108.(1) This section applies if— (a) immediately before its commencement, there was a prescribed form for a matter in the schedule of this regulation that was repealed on the commencement; and (b) on the commencement, there is to be an approved form for the matter or a form may be approved for the matter. 1 Under the Acts Interpretation Act 1954 , section 33(5B) a reference to the chief executive means the chief executive of the department.

(3) This section expires 6 months after it commences.’.
