540 QueensInrib ANNO TERTIO DECIMO ELIZABETHAE SECUNDAE REGINAE 40 444 * 0-0 4 0 No. 52 of 1964 An Act to Amend "The Fruit Marketing Organisation Acts, 1923 to 1964," in certain particulars [ASSENTED TO 10TH DECEMBER, 1964] BE IT ENACTED by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows:- 1. (1) Short title . This Act may be cited as "The Fruit Marketing Organisation Acts Amendment Act of 1964 (No. 2)." (2) Principal Act. " The Fruit Marketing Organisation Acts, 1923 to 1964," are in this Act referred to as the Principal Act. (3) Collective title. The Principal Act and this Act may be collectively cited as " The Fruit Marketing Organisation Acts, 1923 to 1964."

Section six of the Principal Act is amended by adding the following subsection:- (7) For the purposes- (a) of the extension pursuant to subsection (3) of section five of this "Act, of paragraph (vi) of subsection (5) of section six of this Act to vegetables; and (b) of sections 6A, 6s, 6c, and 6D of this Act, potatoes, onions, pumpkins, swede turnips, and any other vegetables for the time being excluded from the provisions of this Act shall be deemed to be, and to have always been, vegetables to which this Act applies." 3. Amendments of s. 11 . Section eleven of the Principal Act is amended by- (a) in subsection (1) omitting the words " a group committee for other fruits " and inserting in their stead the words " Other Fruits Group Committee."; (h) in subsection (2)- (i) omitting paragraphs (a), (b) and (c) and inserting in their stead the following paragraphs:- " (a) Subject to this subsection the Deciduous Group Committee shall have and may exercise all of the powers and functions of- (i) The Vegetable Group Committee with respect to vegetables; and (ii) the Other Fruits Group Committee with respect to tomatoes, grown within the part of the State comprised by the Shires of Glengallan, Inglewood, Rosenthal and Stanthorpe and the City of Warwick. Subject to this subsection the Other Fruits Group Committee shall have and may exercise all of the powers and functions of the Deciduous Group Committee with respect to deciduous fruits grown without the part of the State comprised by the Shires of Glengallan, Inglewood, Rosenthal and Stanthorpe and the City of Warwick. (b) (i) The Governor in Council may, by Order in Council, direct that the Deciduous Group Committee shall cease to have and exercise the powers and functions of the Vegetable Group Committee with respect to vegetables or any class or classes of vegetables grown within the part of the State comprised by the Shires of Glengallan, Inglewood, Rosenthal

542 Fruit Marketing Organisation Acts, Etc., Act of 1964, No. 52 and Stanthorpe and the City of Warwick and, on and after the date specified in any such Order in Council, all of the powers and functions under this Act or a sectional group committee shall, as respects vegetables grown in the said part of the State or, as the case may be, the class or classes of vegetables so grown as specified in the Order in Council, be had and exercised by the Vegetable Group Committee. (ii) The Governor in Council may by Order in Council direct that the Deciduous Group Committee shall cease to have and exercise the powers and functions of the Other Fruits Group Committee with respect to tomatoes grown within the part of the State comprised by the Shires of Glengallan, Inglewood, Rosenthal and Stanthorpe and the City of Warwick and, on and after the date specified in such Order in Council, all of the powers and functions under this Act of a sectional group committee shall, as respects tomatoes grown in the said part of the State, be had and exercised by the Other Fruits Group Committee. (iii) The Governor in Council may by Order in Council direct that the Other Fruits Group Committee shall cease to have and exercise the powers and functions of the Deciduous Group Committee with respect to deciduous fruits grown without the part of the State comprised by the Shires of Glengallan, Inglewood, Rosenthal, and Stanthorpe and the City of Warwick and, on and after the date specified in such Order in Council, all of the powers and functions under this Act of a sectional group committee shall, as respects deciduous fruits grown without the said part of the State, be had and exercised by the Deciduous Group Committee. (c) The Vegetable Group Committee shall not have or exercise any power or function under this Act with respect to any vegetables grown within the part of the State comprised by the Shires of Glengallan, Inglewood, Rosenthal and Stanthorpe and the City of Warwick, unless thereunto authorised by an Order in Council made pursuant to paragraph (b) of this subsection. The Other Fruits Group Committee shall not have or exercise any power or function under this Act with respect to any tomatoes grown within the part of the State comprised by the Shires of Glengallan, Inglewood, Rosenthal and Stanthorpe and the City of Warwick, unless thereunto authorised by an Order in Council made pursuant to paragraph (b) of this subsection. The Deciduous Group Committee shall not have or exercise any power or function under this Act with respect to any deciduous fruits grown without the part of the State comprised by the Shires of Glengallan,

No. 52 543 Inglewood, Rosenthal and Stanthorpe and the City of Warwick, unless thereunto authorised by an Order in Council made pursuant to paragraph (b) of this subsection."; and (ii) in paragraph ( d) omitting the words " with respect to vegetables whether grown within or without the Granite Belt " and inserting in their stead the words " with respect to deciduous fruits or vegetables or tomatoes , whether grown within or without the part of the State comprised by the Shires of Glengallan , Inglewood , Rosenthal, and Stanthorpe and the City of Warwick."
