B E it enacted by the King's Most Excellent Majesty, by and with the advice and consent of the Legis- lative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows ; - 1. This Act may be cited as " The Fruit Marketing Short title Organisation Acts Amendment Act of 1945," and shall :ndstruction. be read as one with *" The Fruit Marketing Organisation on Acts, 1923 to 1941," herein referred to as the Principal Act. The Principal Act and this Act may collectively be Colleetive cited as "The Fruit Marketing Organisation Acts, 1923 title. to 1945." Amendments of the Principal Act. 2. The following section, numbered lA, is inserted New s. lA after section one of the Principal Act, namely ;_ inserted. Section two of the Principal Act is amended as Amendments follows ;- of s. 2. (a) The definition" Marketing" therein is repealed and the following definition is inserted in lieu thereof, namely;- " "Marketing "-Includes- Ma.rketing. (a) Everything involved in the preparation and packing of fruit and/or vegetables for sale and in the offering thereof for sale and the selling thereof and in the transmission of the fruit and/or vegetables from the producer to the consumer; and * 14 G. 5 No. 39 and amending Acts, v. 7, p. 870 et aeq.

No. 9, (b) (As respects· the Committee of Direction acting as principal or agent) the refrigera- tion, cold storage, andlor ripening of fruit andlor vegetables; and (c) (As respects the Committee of Direction acting as principal, either alone or, with the approval of the Governor in Council, in conjunction with any person or body corporate) the processing, manufacture, and treatment of fruit andlor vegetables and the offering for sale and the selling of the processed, manufactured, or treated fruit or vegetables or any product derived from such processing, manufacture, or treatment. " (b) The definition "Sectional group committee" therein is amended by inserting therein after the word " industry" the words" or representative of the vegetable industry." (c) The definition" Vegetables" therein is repealed and the following definition is inserted in lieu thereof, namely:- Vegetables. " " Vegetables "-All or any vegetables grown in Queensland exclusive of potatoes, onions, pumpkins, swede turnips, or of any other vegetables which the Governor in Council may, from time to time by Order in Council, declare shall be excluded from the provisions of this Act." Repeal of 4. Section five of the Principal Act is repealed Ban.5d. new and the following section is inserted in lieu thereof, namely:- Constitution "[5.] (1.) There is hereby constituted a Sectional Vofegetable Group Committee in relation to vegetables to be named Group the "Vegetable Group Committee," and consisting of Committee. such number of members (not being more than twelve) as may be prescribed. The first members ofsuch Sectional Group Committee shall be appointed by the Minister on the recommendation of the Committee of Direction and shall hold office until the election and appointment of the elected members of such Sectional Group Committee in such manner as shall be prescribed, when the members so appointed by the Minist~ r shall all go out of office unless they or any of them are so elected and appointed.
1945. PRIMARY PRODUCE. Fruit ~ Marketing Organisation, Etc., Act. Any casual vacancy occurring in such Committee while consisting of members so appojnted by the Minister may be filled by the Mjnister by the appointment of a member on the recommendation of the Committee of Direction. (2.) The Vegetable Group Committee consisting of members so appointed by the Minister shall at its first meeting elect two of its members to be members of the Committee of Direction and they shall hold office until the Vegetable Group Committee consisting of elected members shall elect two of its members as shall be prescribed to be members of the Committee of Direction, when the two first named appointees shall go out of office unless they or either of them are or is so re-elected. (3.) The provisions of this Act are hereby extended to vegetables and to the Vegetable Group Committee and to all persons, things and matters concerned, and the Committee of Direction and, subject to subsection two of section eleven of this Act, the Vegetable Group Committee shall respectively henceforth have with respect to vegetables the like functions, powers, authorities, duties, and responsibilities as the Committee of Direction has under this Act with respect to fruit and as any other Group Committee has under this Act with respect to fruit so far as concerns its own section. (4.) Until provisions have been prescribed with respect to the election of members of the Vegetable Group Committee, and the election by such Committee of members of the Committee of Direction, and generally with respect to the Vegetable Group Committee, the Regulations in force with respect to Group Committees generally shall, subject to the provisions of this section, where relevant and so far as practicable, have effect, mutatis mutandis, with respect to the Vegetable Group Committee: Provided that the first elected members of the Vegetable Group Committee shall be elected in the month of August, one thousand nine hundred and forty-six. (5.) The provisions of this Act relating to "fruit," or "fruit growers," or "fruit growing," respectively, shall unless otherwise precluded by the context 391

No. 9, mutatis mutandis henceforth be deemed to relate also to "vegetables," "vegetable growers," or "vegetable growing," respectively, and shall subject as aforesaid henceforth be read and construed and have effect as if the words "and/or vegetables," "and/or vegetable growers," and" and/or vegetable growing" respectively were (where not already expressly inserted by this Act) inserted after the words "fruit," "fruitgrowers," and "fruit growing" respectively, wherever these .Jast- mentioned words respectiv;ely occur in this Act; the word "grower" wherever used in this Act shall mean and include a "fruit grower," and also a "vegetable grower." " Amendment 5. Subsection five of section six of the Principal of s. 6 (5). Act is amended as follows :_ [General (a) The following words are added to paragraph (i.) ~wer\ ~ f thereof, namely :-" in the State of Queensland or in of~ ~ t: n. ] any other State or territory of the Commonwealth of Australia." (b) The following words are added to paragraph (vi.) thereof, namely :-" and to do all or any of such things as either principal or agent." ::d New ss. 6A, 6. [6c.] Notwithstanding anything to the contrary in Power.of this Act contained the Committee of Direction shall have ~ ;: ~ ~! ~ r~ n the power to enter upon and carry into execution the to o~ rate marketing outside of the State of Queensland of fruit and Q~: ~ ~la.nd. vegetables grown in the State of Queensland and fruit and vegetables grown outside of the State of Queensland and for that purpose to do outside of Queensland all such things as are deemed by the Committee of Direction necessary or convenient, and in particular for such purpose to establish places of business and offices outside of Queensland and to appoint employ and pay such officers, employees, agents, and other persons outside of Queensland as are by the Committee of Direction deemed necessary. [6D.] The Committee of Direction shall have the Gen~ ral power to buy or otherwise acquire, and to sell and supply ~~ :~ of to fruit growers and/or vegetable growers and other Co~ itt~ e persons, and otherwise to trade in, and either for cash or ofDIrectIOn. on terms and if on terms upon security, farming, agricultural, orcharding, and transportation implements, plant, machinery with all accessories, fertilisers, fruit trees, seeds, oils and fuels, fruit and vegetable cases and other fruit and vegetable containers, bags, and general farming, agricultural, and orcharding transportation and marketing requisites of any kind whatsoever. [6E.] (1.) If the Committee of Direction satisfies Minister .for the Secretary for Public Lands that it requires any land ~ ; ; ~ v: : ~ for any purpose relating to the marketing of fruit and/or gover~ or in vegetables and that it is unable to obtain such land by t: : f~ ~ ay agreement, the said Minister may, with the prior

No. 9, approval of the Governor in Council, take such land, under and subject to the provisions of *" The Public Works'Land Resumption Acts, 1906 to 1940." (2.) Subject to this section, marketing as defined in this Act shall be a purpose for which land may be taken under *" The Public Works Land Resumption Acts, 1906 to 1940," and as respects the taking of land for such purpose the Secretary for PubliC' Lands shall have and may exercise all of the powers and authorities of the Crown as a constructing authority under such lastmentioned Acts. Indemnity of (3.) The proclamation taking any land, or a later Crown. proclamation, shall vest such land in the Committee of Direction. Moreover, the Committee of Direction shall be liable for and shall pay the compensation in respect of such land and all other costs, charges, and expenses incurred in connection therewith; and the Crown and the said Minister are hereby indemnified against all claims and liabilities in respect of such taking. (4.) In this section the term "land" means land as defined by t" The State Development and Public Works Organisation Acts, 1938 to 1940"." New s. 6F 7. The following section, numbered 6F, is inserted inserted. after section 6E of the Principal Act as previously inserted by section six of this Act, namely :- When. "[6F.] (1.) PRIMARY PRODUCE. 395 1945. Fruit Marketing Organisation, Etc., Act. (2.) Upon the making of an Order in Council under this section, the Committee of Direction shan- (i.) On or before the date specified therein or, if the date upon which it is to commence the required business is not so specified, as soon as may be commence business as required by such Order in Council; and (ii.) Thereafter at all times when such Order in Council is in force carry on and continue such business to the extent necessary to ensure the supply in reasonable quantities of all fruit and vegetables for which there is a reasonable demand by the public in the Local Authority Area or Areas in question and supplies of which are reasonably obtain- able by the said Committee. (3.) The Committee of Direction may make repre- sentations to the Minister with respect to any Order in Council proposed to be made under this section and the Minister shall place all such representations before the Governor in Council for consideration. 8. Section seven of the Principal Act is amended Amendment as follows:- ofa.7. (a) In subsection two thereof the full stop at the[~ ntrolof end of subparagraph (e) of paragraph (i.) is converted~ ':! .:b~ into a semi-colon, the word "or" is added to such marketing.] subparagraph, and the following new subparagraph . (f) is added to such paragraph, namely:- "(f) All or any of the varieties of vegetables." (b) Subsection three thereof is amended by inserting, after the words" such notice" in the second paragraph of the said subsection three, the words "if more than one," and is further amended by the addition thereto of the following paragraph, namely:- " If in the opinion of the Chairman of the Committee When of Direction a direction should be issued under the ch~ provisions of this section he may direct that the notice = rc~ B: : e . referred to in this subsection be published and he is direction. hereby authorised to act in that behalf on behalf of the Committee of Direction and for and on behalf of the Oommittee of Direction to decide that it is the intention of the Committee of Direction to issue such direction, provided that such direction shall not be issued before

No. 9, or until the same has been approved by the Committee of Direction and provided further that the Committee of Direction may so approve at any time after the date of the first public advertisement, if more than one, referred to in this subsection." (c) The second paragraph of subsection five thereof is repealed and the following paragraph is inserted in lieu thereof, namely :- " Any person who- (i.) Fails to comply with or acts in contravention of any provisions of a direction duly issued under this section; or (ii.) Offers by advertisement or otherwise to buy or to accept delivery of fruit and/or vegetables from any person who, upon accepting such offer and selling or delivering such fruit and/or vegetables to such firstmentioned person, would act in contravention of such a direction shall be guilty of an offence against this Act." (d) Subsection seven thereof is repealed and the following subsection is inserted in lieu thereof, namely ;- Meaning of " (7.) (i.) For the purposes of this section the term newspaper. "newspaper" shall mean and include any newspaper or journal registered at the General Post Office, Brisbane, for transmission by post as a newspaper. Authorisa. tion of general manager to issue direction. (ii.) The Committee of Direction may by resolution either generally or in any particular case authorise its general manager to issue on its behalf any such direction as and when the same may be issued pursuant to the provisions of this section, and the issue of such direction on behalf of the Committee of Direction by such general manager so authorised shall be as effective as if the same had been issued by the Committee of Direction. For the purposes of this paragraph the term "general manager" includes any person for the time being performing the duties of general manager. Committee. (iii.) (e) Subsection eight thereof is repealed and the following subsection is inserted in lieu thereof, namely ;- proce"ss(I . 8n.) g, Emvearnyu £ paecr t suorne,caorrrytirnegatomnetnhte 0 b f us f riUn ' eI t ssaonf d t / hoer Eaofunfttihcreo y rr. l ? s f ed vegetables shall at all reasonable times permit any officer of the Department of Agriculture and Stock duly authorised in writing by the Minister to enter upon the premises of such person wherein he shall be carrying on such business and to inspect all fruit and/or vegetables in, on or about such premises and being of any class or classes of fruit and/or vegetables subject for the time being to a direction issued under this section affecting the selling or consigning or delivery of such class or classes of fruit and/or vegetables to any such person, and to inspect and examine such of the books, accounts and records of such person as may be necessary in the opinion of such officer to ascertain whether any person is guilty in relation to such direction of any offence against this Act, and any such person who obstructs, hinders or prevents any such authorised officer entering upon such premises and/or inspecting such fruit and/or vegetables and/or inspecting and examining such books, accounts and records shall thereby be guilty of an offence against this Act. (j) The following new subsection numbered 8e is inserted after subsection 8B thereof, namely;- "[8e.] (i.) (ii.) The provisions of this Act shall continue to have and it is hereby declared always have had full force and effect after the said thirty-first day of

No. 9, December, one thousand nine hundred and forty-four~ until repealed by Statute, and the Committee of Direction as constituted by this Act shall, subject as aforesaid, continue to perform its duties and to exercise its functions under this Act as a permanent body corporate." Amendments 9. Section eight of the Principal Act is amended of 8. 8. as follows:- (a) Subsection one thereof is repealed. (b) Subsection two thereof is renumbered subsection one. (c) The following subsection, numbered two, is inserted therein after subsection one as previously renumbered by this section, namely:- Power of "(2.) Whenever any grower has or claims to have ~ rn: ! ! : n any right of action against any person or authority or to act ~ whenever any grower is threatened with proceedings proceedings. against him civilly or criminally or such proceedings are commenced against him, and the Committee of Direction is of opinion that there is involved some question which is of common interest to all growers or to any section or class of growers, the Committee of Direction shall have power and authority to act on behalf of such grower in the prosecution of such right of action or in the defence of such proceedings and to apply the funds of the Committee of Direction towards the payment of all costs and expenses incurred in the prosecution of such right of action or in the defence of such proceedings and any damages or costs that may be awarded in such proceedings : Provided that in the event of costs and/or expenses being awarded to such grower in any such action or proceedings, the Committee of Direction shall be entitled to claim from such grower the amount of costs and/or expenses incurred by it but not exceeding the amount so awarded less the costs and/or expenses, if any, incurred by such grower in respect of such action or proceedings." I Repeal of 10. Section nine of the Principal Act is repealed and and new s. 9. the following section is inserted in lieu thereof, namely : - [Constitution "[9.] (1.) The Committee of Direction shall be ~ 'tt fconstituted by the appointment by the Minister of not D:onjO more than two representatives of each and every sectional group committee elected by the sectional group committees respectively.

In addition to the representatives specified in subsection one of this section, the Director of Marketing shall be ex officio a member of the Committee of Direction. The Governor in Council shall also appoint a person as member of the Committee of Direction who shall represent the consumers thereon. (3.) The Minister may appoint another person with general authority to act as a member of the Committee of Direction in the room of the Director of Marketing during any absence of the said Director. The Minister shall likewise appoint any person to act as consumers' representative during the. absence of such representative. The fact that such person or persons so acts or act shall be conclusive evidence of the absence of the said Director or, as the case may be, the consumers' representative. (4.) Subject to this Act, the elected members of the Committee of Direction and the consumers' representative shall hold office for a period of three years, but every such member shall, subject in the case of any elective member to his re-election, be eligible for reappointment. J5.) The provisions of this section shall apply and extend so as not to prejudice the tenure of office of any member of the Committee of Direction holding such office at the passing of*"The Fruit Marketing Organisation Acts Amendment Act of 1945," and every such member shall, subject to this Act, continue in office until the expiry, by effluxion of time, of the period for which he was entitled to hold office in pursuance of the pro- visions of this Act in force. immediately prior to the passing of such amending Act." 11 Section eleven of the Principal Act is amended Amendments as follows :_ of s. 11. (i.) In subsection one thereof- (a) The word "five" is repealed and the word " six" is inserted in lieu thereof. (b) The word "and" is repealed and the full stop after the word" fruits" is converted into a comma. (c) The following words are added, namely, ".and a Vegetable Group Committee." * This Act.

Subsection two thereof is repealed and the following subsection is inserted in lieu thereof, namely:- Powers of Deciduous Group Committee in Granite Belt. "(2.) (a) Subject to this subsection the Deciduous Group Committee shall have and may exercise all of the powers and functions of the Vegetable Group Committee with respect to vegetables grown in the fruit and vegetable growing area of the State known as the Granite Belt. . In the event of any dispute or complaint to the Minister as to whether any vegetables are growing or have been grown within the Granite Belt or with respect to whether any area or areas is or are within or without such Belt, the Minister may appoint a person to decide such complaint or dispute and the decision of such person shall be notified in the Gazette by the Minister and shall be binding upon the Deciduous Group Committee, the Vegetable Group Committee and all other persons concerned. (b) The Governor in Council may, by Order in Council, direct that the Deciduous Group Committee shall cease to have and exercise the powers and functions of the Vegetable Group Committee with respect to vegetables or any class or classes of vegetables grown within the Granite Belt and, on and after the date specified in any such Order in Council, all of the powers and functions under this Act of a sectional group committee shall, as respects vegetables grown in the Granite Belt or, as the case may be, the class or classes of vegetables so grown specified in the Order in Council, be had and exercised by the Vegetable Group Committee. (c) The Vegetable Group Committee shall not have or exercise any power or function under this Act with respect to any vegetables grown within the Granite Belt unless thereunto authorised by an Order in Council made pursuant to paragraph (b) of this subsection. (d) The provisions of this subsection shall be read and construed and shall have operation and effect so as not to prejudice any power or function had by the Committee of Direction under this Act with respect to vegetables whether grown within or without the Granite Belt." (iii.) In subsection five thereof the word" five" is repealed and the word " six " is inserted in lieu thereof and the word " ten" is repealed and the word " twelve" is inserted in lieu· thereof.

The Committee of Direction shall pay to its members and to the members of each Sectional Group Committee the fees and/or allowance1j and/or travelling expenses so fixed. U nti! the Committee fixes fees and/or allowances and/or travelling expenses in pursuance of its powers under this section, the respective fees and/or allowances and/or travelling expenses payable under the regulations immediately prior to the passing of *"The Fruit Marketing Organisation Acts Amendment Act of 1945" shall continue to be payable to members of the Committee of Direction and of each Sectional Group Committee." 13. The following sections, numbered 14B and 140, New ss. 14B are ilnserted after section 14A of the Principal Act, ~ ~ l' ! : ~ . namey:- " [14B.] (i.) The funds of the Committee of Direction FWlds. shall consist of- (a) Moneys derived from general activities not directly conducted for and on behalf of any Sectional Group Committee or Sectional Group Committees; and (b) Moneys derived from levies and activities conducted directly on behalf of any specific Sectional Group Committee or Sectional Group Committees. (ii.) All funds derived in manner referred to in paragraph (b) of the preceding subsection shall so far as practicable be allocated in the books of the Committee of Direction between the different Sectional Group Committees according to the extent to which the different sections have respectively contributed thereto, and all * This Act.

No. 9, 1945. expenses being the general administrative and business expenses of the Committee of Direction including all fees, allowances, and travelling expenses to members of the Committee of Direction and of the Sectional Group Committees shall be debited to and allocated between .the different Sectional Group Committees and the funds derived in manner referred to in paragraph (a) of the preceding subsection as determined by the Committee of Direction from time to time. Moneys derived from levies shall be applied in accordance with the purposes for which they were imposed. Superannua- [140.] The Committee of Direction shall have power ftioornfunds to establish and support or aid in the establishment employees. and support of superannuation or provident schemes or plans or trusts for the benefit of its employees and their dependants, and to subsidise and to contribute and make payments from the funds of the Committee of Direction to the funds created and held in connection with any such schemes, plans, or trusts." Amendment 14. (1.) Subsection one of section fifteen of the of s. 15 (1). Principal Act is amended as follows : - (a) Subparagraph (i.) of the second paragraph thereof is repealed. (b) In subparagraph (vi.) of the second paragraph thereof the words "for the purpose of defraying all expenses under this Act" are repealed. (c) In subparagraph (x.) of the second paragraph thereof the words "to provide for the expenses of marketing" are repealed. (2.) Any fees, allowances and travelling expenses payable to members of the Committee of Direction or any Sectional Group Committee pursuant to regulations made under the provision of the Principal Act repealed by subsection one of this section shall continue to be so payable until the Committee of Direction or, as the case may be, such committee, pursuant to its powers in that behalf prescribed by section twelve of *" The Fruit Marketing Organisation Acts, 1923 to 1945," fixes the fees and/or allowances so payable.
