B E it enacted by the King's Most Excellent Majesty, by and with the advice and consent of the Legis- lative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows:- . 1. This Act may be cited as " The Fruit Marketing Short title Organisation Acts Amendment Act of 1934," and shall be ~~~ struction. read as one with *" The Fruit Marketing Organisation Acts, 1923 to 1930," herein referred to as the Principal Act. The Principal Act and this Act may collectively be cited as " The Fruit Marketing Organisation Acts, 1923 to 1934." Amendment of the Principal Act. 2. Ce that I' t I.S " MTahrkee F ti r n u g ~ t the intention of the Governor in Council to extend the Organisation operation of the provisions of *" The Fruit Marketing ~~~ ndment Organisation Acts, 1923 to 1930," for a further period Act of 1934." of five years from the date when the provisions of such Acts shall expire by effluxion of time (as fixed by the said Acts and Orders in Council issued thereunder) : Moreover the Governor in Council may also give notice that he is prepared to receive within thirty days (or such further time as may be specified in such Order in Council) a requisition of five hundred prescribed fruit- growers demanding a ballot on the question of such continuance. If such requisition is received within the time prescribed in the Order in Council giving notice as aforesaid, the Minister may direct that such vote be taken. * 14 Geo. V. No. 39, 16 Geo. V. No. 23, A vote of such growers shall accordingly be taken, and if less than one-half of the votes polled are in favour of the continuance of the provisions of *" The Fruit Marketing Organisation Acts, 1923 to 1930," the provisjons of such Acts shall cease to be operative. If, however, not less than one-half of the votes polled are in favour of the continuance of the provisions of Ruch Acts, then the Governor in Council shall by Order in Council published in the Gazette direct and declare that the provisions of *" The Fruit Marketing Organisation Acts, 1923 to 1930," shall be in full force and shall continue in force for the said period of five years; and such Acts shall be of full force and effect accordingly : Provided that if such requisition is not received within the time prescribed in the Order in Council giving notice as aforesaid, or if any such requisition is received but is signed by less than the requisite number of prescribed growers as aforesaid, then the Governor in Council, without the holding of any vote, shall by Order in Council published in the Gazette direct and declare that the provisions of * " The Fruit Marketing Organisation Acts, 1923 to 1930," are and shall be in full force and shall continue in force for the said period of five years; and such Acts shall, subject to the provisions thereof, be of full force and effect accordingly. For the purposes of this subsection the provisions of *" The Fruit Marketing Organisation Acts, 1923 to 1930," are hereby declared to be extended for such additIOnal period of time as may be required to enable all the provisions of this subsection to be complied with; and moreover the Committee of Direction and any committee under the said Acts shall continue to perform their duties and to exercise their functions during such extended period of time accordingly. Any Order in Council issued or purporting to be issued under this subsection shall have the same force of law as if it were enacted in and formed part of * " The Fruit Marketing Organisation Acts, 1923 to 1930," and shall be judicially noticed and shall be obeyed by all persons concerned. The power to make regulations under *" The Fruit Marketing Organisation Acts, 1923 to 1930," shall extend and apply to the provisions of this subsection * 14 Geo. V. No. 39 and amending Acts, supra, pages 10766 et seq.
PRIMARY PRODUCE. 15099 1934. Fruit Marketing, Etc., Amendment Act. and, where there may be in the Act or in this subsection no provision or no sufficient provision in respect of any matter or thing necessary or expedient to give effect to the provisions of this subsection, regulations may be made providing for and supplying such omission or insufficiency. (ii.) The provisions of this subsection 8B may beFurtho.r extended from time to time by Order in Council published ~ b~ ~ ~ tlOn of in the Gazette to the intent that if *" The Fruit Marketing provisions. Organisation Acts, 1923 to 1930," shall, pursuant to the above provisions, be extended for a further period of five years, the said subsection shall apply and have effect in respect of any further extension or extensions of the provisions of the said Acts, for any further prescribed period including the procedure in regard thereto; and the provisions of the said subsection shall, mutatis mutandis, apply and have effect and enure accordingly." * 14 Geo.
