An Act relating to the destruction and control of certain insects affecting fruit and vegetables,
and other matters incidental thereto.
BE IT ENACTED by the Governor of the State of South Australia, with the advice and consent of the Parliament thereof, as follows:
Short title
1. This Act may be cited as the Fruit Fly Act, 1947.
Interpretation
2. In this Act—

"fruit fly" means—
(a)
the insect known as Ceratitus Capitata (Wild), or the Mediterranean fruit fly (formerly called Halterophora);
(b)
the insect known as Struheta Tryoni (Frogg), or the Queensland fruit fly (formerly called Tephritis Tryoni).

Compensation
3. (1) The Minister may, out of moneys provided by Parliament for the purpose, pay compensation to any person who has suffered loss in consequence of measures taken in pursuance of statute to control or eradicate fruit fly.
(2) An application for compensation under this section—
| (a) | must be in writing; |
| (b) | must be made in a manner and form determined by the Minister; |
| and | |
| (c) | must be supported by such evidence as the Minister may require. |
(3) No action lies against the Minister to compel him to make a payment of compensation under this section.

Regulations
9. The Governor may make any regulations which it is necessary or convenient to make for the purposes of the administration of this Act, and may by any such regulation prescribe fines recoverable summarily but not exceeding one hundred dollars for breach of any such regulation.
