FRUIT CASES (AMENDMENT)

ACT.

Act No. 17, 1036.

An Act to amend the Fruit Cases Act, 1912, as amended by subsequent Acts, in certain respects; and for purposes connected there- with. [Assented to, 17th June, 1936.]

1 . (1) This Act may be cited as the " F r u i t Cases (Amendment) Act, 1936," and shall be read and con- strued with the Fruit Cases Act, 1912, as amended by subsequent Acts. (2)

BE it enacted by the King's Most Excellent Majesty, lative Council and Legislative Assembly of New South by and with the advice and consent of the Legis-

Wales in Parliament assembled, and by the authority of the same, as follows :—

(2) The F r u i t Cases Act, 1912, as so amended, is

in this Act refer red to as the Pr inc ipa l Act.

(3) The Pr inc ipa l Act as amended by this Act may

be cited as the F r u i t Cases Act, 1912-1936.

2.   The Principal Act is amended—

(a) by omitting section six and by inserting in lieu thereof the following section:—

6 . No person shall sell a quant i ty of frui t equal to or exceeding one-quarter of a bushel in any bag or sack except for manufac tu r ing purposes .

(b) by omi t t ing p a r a g r a p h (d) of section eight and
by inser t ing in lieu thereof the following p a r a ­
g r a p h :—

(d)

contravenes the provisions of section six of this Act.

(c)

by omitting subsection two of section ten and by inser t ing in lieu thereof the following subsec­ tion :—

(2) The regulat ions shall—

(a) be published in the Gaze t te ;

(b)

take effect from the date of publication or from a la te r date to be specified in the regu­ la t ion- ; and

(c) be laid before both Houses of Pa r l i amen t

within fourteen s i t t ing days af ter publica­ tion if Pa r l i amen t is in session, and if not, then within fourteen s i t t ing days af ter the

commencement of the next session.

If ei ther House of Pa r l i amen t passes a resolut ion of which notice has been given a t a n y t ime within fifteen s i t t ing days af ter the regulat ions have been laid before that House disallowing any regula t ion or p a r t

thereof, the regulat ion or p a r t shall there­
upon cease to have effect.
