FRUIT CASES.
No. 17 of 1966.
AN ACT to amend the Fruit Cases Act, 1919-1965.
[Assented to 17th October, 1966.]
RE it enacted by the Queen's Most Excellent
Majesty, by and with the advice and consent
of the Legislative Council and the Legislative
Assembly of Western Australia, in this present
Parliament assembled, and by the authority of the
same, as follows:—

| amended. | 2. Section five of the principal Act is amended by substituting for the words, "seven shillings and sixpence" in the last two lines of paragraph (b) of the proviso, the passage, "seventy-five cents". |

amended
| (a) | by adding immediately before the inter- pretation, "direct buyer" in subsection (1), the following interpretation |
"citrus" includes oranges, mandarins,
lemons and grapefruit; ;
| (b) | by substituting for the interpretation, "direct buyer" in subsection (1), the following interpretation |
"direct buyer" means
| (a) | a person who, not being a direct buyer registered under this section, purchased or purchases direct from a grower or growers during the period of two years ending on the thirty-first day of December, one thousand nine hundred and sixty-six an annual average quantity of not less than one hundred bushels of apples, or of pears, or of citrus for the purpose of selling the same either wholesale or retail; or |
| (b) | a person who purchases direct from a grower or growers for the purpose of sale either wholesale or retail an aggre- gate quantity of not less than one hundred bushels of apples, |

or of pears, or of citrus, during any period of twelve months commencing on the first day of January, the first of which periods shall commence on the first day of January, one thousand nine hundred and sixty-seven; ;
| (c) | by inserting after the word, "apples" where it occurs in each of lines two, four and six of the interpretation, "grower" in subsection (1), the passage, ", pears or citrus", in each case; |
| (d) | by substituting for the interpretation, "prescribed grades" in subsection (1), the following interpretation |
"prescribed grades", when used in relation to apples, pears or citrus, means the respective grades of apples, pears or kinds of citrus, as the case may require, prescribed by regulations made under the Agricultural Products Act, 1929. ;
| (e) | by substituting for the passage, "sixty- three" in line five of paragraph (a) of subsection (2), the passage, "sixty-seven"; |
| (f) | by inserting after the word, "apples" in line one of subsection (3), the passage, ", pears or citrus"; |
| (g) | by deleting the words, "of apples" in line five of subsection (3); |
| (h) | by inserting after the word, "apples" where it occurs in line two of paragraph (a), and again in line one of paragraph (c), of subsection (3), the passage, ", pears or citrus", in each case; and |
(i) by substituting for the passage, "sixty-six" in the last line of subsection (6), the passage, "sixty-eight".
