An Act to prevent damage to fruit and vegetables in course of transit.

BE IT ENACTED by the Governor of the State of South Australia, with the advice and consent of the Parliament thereof, as follows:

Short title

1. This Act may be cited as the Fruit and Vegetables (Prevention of Injury) Act, 1927.

Application of Act

2. This Act shall apply to persons in the employ of the Crown as well as to other persons.

Interpretation

3. In this Act—

"case" means any box, case, or other receptacle used for containing fruit or vegetables:
"inspector" means an inspector appointed under the Vine, Fruit, and Vegetable Protection Act, 1885-1936, as amended, or under any corresponding subsequent enactment, and includes the chief inspector so appointed.

Powers of inspectors

4. (1) Any inspector may enter any vehicle, ship, boat, or place where he has reason to believe that any cases of fruit or vegetables are being handled, stacked, or loaded for transport or are stacked or loaded for transport and may remain in such vehicle, ship, boat, or place for the purpose of inspecting the handling, stacking, or loading of any such cases, and giving directions as provided in subsection (2) of this section.

(2) Any inspector may give such reasonable directions to any person immediately in charge of the handling, stacking, or loading of any cases of fruit or vegetables or to any person immediately in charge of any stack or load of fruit or vegetables in cases as are necessary to prevent damage to the fruit or vegetables in such cases.

(3) Any person who—

(a)

hinders or obstructs an inspector in the exercise of any of his powers under this section; or

(b) fails to comply with any such direction as aforesaid

shall be guilty of an offence punishable summarily and shall be liable to a penalty not exceeding

fifty dollars.

Regulations

5. The Governor may make all such regulations as are necessary or convenient for preventing damage to fruit and vegetables in course of transit, and may by any such regulations create offences punishable summarily and prescribe penalties therefor not exceeding fifty dollars.

Financial provision

6. Any moneys required for the purposes of this Act shall be paid out of moneys provided by Parliament for the purposes.
