AGRICULTURE. 3 GEO. VI. No. 25, 1939. Fruit and Vegetables Acts Amendment Act. All Proclamations, Orders in Council, and regulations shall be laid before Parliament within fourteen days after such publication if Parliament is in session; and if not, then within fourteen days after the commencement of the next session. If Parliament passes a resolution disallowing any such Proclamation, Order in Council, or regulation, of which resolution notice has been given at any time within fourteen sitting days of such House after such Proclamation, Order in Council, or regulation has been laid before it, such Proclamation, Order in Council, or regulation shall thereupon cease to have effect, but without prejudice to the validity of anything done in the meantime or to the power to make any further or other Proclamation, Order in Council, or regulation. B E it enacted by the King's Most Excellent Majesty, by and with the advice and consent of the Legis- lative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows : - 1. This Act may be cited as "The Fruit and Short title. Vegetables Acts Amendment Act of 1939," and shall be read as one with '*"The Fruit and Vegetables Acts, 1927 to 1935," herein referred to as the Principal Act. The Principal Act and this Act may be collectively CoJIective cited as "The Fruit and Vegetables Acts, 1927 to 1939." title. * 18 Geo. V. No. 3 and amending Act, supra, pages 11840 et seg.

A of m •• en3d. ment as fo2ll.owSsec: ti-on three of the Principal Act is amended (a) A new definition" Dried fruit" is inserted after the definition " Disease," namely :- Dried fruit. " "Dried fruit"-Means dried currants, dried sultanas, lexias, dried apricots, dried nectarines, dried peaches, dried pears, dried prunes, and such other fruits that have been dried: and for the purposes of this interpretation fruits shall be deemed to be dried if they are completely dried or are iD. the process of being dried or have been or are being subject to any further treatment or process or action." Grad. (b) In the definition "FruW' the words "or tomatoes" are repealed and the words "tomatoes, or dried fruit" are inserted in lieu thereof. (c) The definition "Grade" is repealed, and the following new definition is inserted in lieu thereof, namely:- " "Grade"-Includes relation to appearance, colour, cleanness, flavour, freshness, ripeness, kind, maturity, number, packing, quality, size, form, soundness, texture, variety, and weight, and derivatives of the word" grade" shall have a corresponding inclusive meaning." (d) In the definition "Inspector," the figures and word" 1916 to 1924" " are repealed, and the figures and word" 1929 to 1937 " " are inserted in lieu thereof. (e) A new definition" Place" is inserted after the definition "Person," as follows:- P1a.e • " " Place"-Includes any building, structure, ship, aircraft, barge, boat, vehicle, car, station, wharf, shed, or any land or premises whatsoever and wheresoever situated." Amendment 3. In section four of the Principal Act the words of B. 4. "other than dried fruit" are inserted after the word " fruit" where such last-mentioned word first occurs.

In sub-paragraph (i.) of paragraph (f) of sub- Amendment section three of section eight of the Principal Act the of s. s. words" colour, kind, number, size, soundness, variety, or weight" are repealed and the words "appearance, colour, cleanness, flavour, freshness, ripeness, kind, maturity, number, packing, quality, size, form, sound- ness, texture, variety, or weight" are inserted in lieu of such repealed words. 5. Section fourteen of the Principal Act is amended Amendment as follows:- of 8. 14. (a) In paragraph (i.) thereof all words from and including the word "number" to and including the word "maturity" are repealed, and the words "appearance, colour, cleanness, flavour, freshness, ripeness, kind, maturity, number, packing, quality, size, form, soundness, texture, variety, weight" are inserted in lieu of such repealed words. (b) Paragraph (iv.) thereof is repealed and the following new paragraphs are inserted in lieu thereof, namely:- " (iv.) The keeping, and inspection of records and Records, statistics of dried fruits received at and/or !i;dOiruit. delivered from any place whatsoever in which or where dried fruits are prepared, stemmed, processed, graded, sorted, or packed whether such place is or is not used for any other purpose; (iv.a) The powers and duties of inspectors, the Powers, ~ ntry by inspectors, for t~ e purp?se o~ sea:rch- ! ~ pe~ ~ oJ' 8 mg for and mspectmg drIed frUIt whICh IS or is believed or suspected to be in or upon any place, and the facilities necessary to enable inspectors to make such searches and inspections and keep records of the same including the opening of packages, the taking of samples of any dried fruit or any product thereof, the inspection of books, accounts, and records, and the taking of copies thereof or of entries therein."
