Excellency Sir William MacGregor, Governor of the Sta,te of Queensland, and under the seal of the said State, dated the fifteenth day of April, one thousand nine hundred and ten, and numbered 97761, a certain piece of land therein described, and containing by admeasurement two roods two and six-tenths perches more or less, situated in the county of Stanley, parish of North Bris- bane, Oity of Brisbane, being allotment 3 of section 60A, Oity of Brisbane, was granted by. His Majesty unto William Berry; John Tait, William Sydney Austin, Andrew Spink, and J ames Lloyd, and their successors for ever, as trustees upon trust as a reserve for a Friendly Societies Hospital and for no other purpose whatsoever: And whereas it is expedient that the said trustees should be empowered to mortgage the said land, and to use the N

No. 17, moneys raised by mortgage for the purpose of the erection of a :Friendly Societies Hospital on the said land: Be it therefore enacted by the King's Most Excellent Majesty, by and with the advice and consent of the Legislative Council and Legislative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows : - Short title. 1. This Act may be cited as "The Friendly Societies Hospital Mortgage A.ct of 1911." Int.erpreta, tion. 2. In this Act the term "Trustees" means and includes the said William Berry, John Tait, William Sydney Austin, Andrew Spink, and James Lloyd, and their successors in whom the said land is for the time being vested, and the term "Committee of Management" means and includes the Committee of Management of the Bris- bane Associated Friendly Societies' Medical Institute, a Friendly Society within the meaning of and duly registered under "The Friendly Societies A.ct of 1894,"* as defined by the registered rules of the said Friendly Society and in force for the time being. New trustees. 3. The Governor in Council may, in the event of the death, resignation, or other removal from office, of the trustees, or any of them, appoint new trustees or a new trustee. Power to 4. Friendly Societies Hospital Mortgage Act. the conditions therein contained or implied; but such power of sale shall not be exercised until such default or breach shall have continued for a period of not less than one month. 6. All moneys to arise from any mortgage made in Ap~ lication P ursu~ , nce , of the powers aforesaid shall be expended in omfoprtrgoacgeee,ds&oc.f the followmg order so far as they extend, that is to say, in payment of- (1) 'The reasonable expenses of and attending such mortgage; . (2) The cost of the erection of a Friendly Societies Hospital on the aforesaid land; (3) 'The cost of all necessary fittings and furniture for the said building. 7. The receipts, in writing, of the trust"ees exercising Tru~ tees' any of the powers , conferred by this Act ' for any moneys raecgeoIopdt to be advanced to them m respect of any mortgage, shall be a discharge. good and sufficient discharge for such moneys to the person or persons advancing the same, and he or they shall not be bound or required to see to the application nor be affected by the misapplication or non-application thereof. 8.
