FRIENDLY SOCIETIES DISPENSARIES
ENABLING ACT.
Act No. 11, 1945
An Act to authorise certain friendly societies conducting dispensaries, to carry on the business of a pharmacist in open shop; for this purpose to amend the Friendly Societies Act, 1912-1942, and the Pharmacy Act, 1897-1940; and for purposes con- nected therewith. [Assented to, 3rd April. 1945.]

| 1 . (1) This Act may be cited as the "Friendly Societies Dispensaries Enabling Act, 1945." | ||
| (2) This Act shall commence upon a day to be appointed by the Governor and notified by proclamation published in the Gazette. Such day shall not be earlier than the date fixed for the commencement of the Pharma- ceutical Benefits Act 1944 of the Parliament of the | ||

2. (1) Subject to this section and to section eighteen of the Pharmacy Act, 1897-1940, but notwithstanding anything elsewhere contained in that Act or in the Friendly Societies Act, 1912-1942, a friendly society which, immediately before the first day of March, one thousand nine hundred and forty-five, was conducting a dispensary or dispensaries for the purposes of dispensing medicines and the sale or supply of medicines and of surgical and medical appliances, requisites and comforts, shall have power and authority to conduct the business of each of such dispensaries in the same manner in all respects as a person who carries on the business of a pharmacist in open shop, and without any limitation as to the persons or classes of persons for whom such medi cines may be dispensed or to whom such medicines, appliances, requisites or comforts may be sold or supplied.
(2) A friendly society shall not exercise the powers and authorities conferred by subsection one of this section in respect of a dispensary conducted by it except at the premises at which such dispensary is conducted at the commencement of this Act, or in lieu of such premises, in other premises which are distant not more than one mile from the premises in which such dispensary is conducted at such commencement.
(3) It shall not be lawful for any department of the Government to make available to a friendly society which exercises the powers and authorities conferred by subsection one of this section any concession or privilege which is not made available equally to persons who carry on the business of a pharmacist in open shop.
from Stamp Duty as set out in the Second Schedule to (4) Paragraph seven of the General exemptions the Stamp Duties Act, 1920-1940, shall not operate to exempt from stamp duty any instrument executed by or on behalf of a friendly society for the purposes of or in connection with the exercise by that society of the powers and authorities conferred by subsection one of this section.
