FRIENDLY SOCIETIES (AMENDMENT) ACT.

Act No. 65, 1967.
An Act to make further provisions with respect to the payment of funeral expenses and other benefits by, and the investment of funds of, friendly societies or branches; for these and other purposes to amend the Friendly Societies Act, 1912, as amended by subsequent Acts; and for purposes connected therewith. [Assented to, 7th December, 1967.]

T>E it enacted by the Queen's Most Excellent Majesty, by
and with the advice and consent of the Legislative
Council and Legislative Assembly of New South Wales in
Parliament assembled, and by the authority of the same, as
follows: —
(1) This Act may be cited as the "Friendly Societies
(Amendment) Act, 1967".
(2) The Friendly Societies Act, 1912, as amended by subsequent Acts and by this Act, may be cited as the Friendly Societies Act, 1912-1967.
The Friendly Societies Act, 1912, as amended by sub
sequent Acts, is amended—
(a)
by omitting from section one the words "Military and naval" and by inserting in lieu thereof the words "Military, naval and air";
(b)
by omitting from subparagraph (ii) of paragraph (b) of subsection two of section ten the words "fire to any amount not exceeding one hundred dollars" and by inserting in lieu thereof the words "loss or damage by fire, burglary, storm or tempest to any amount not exceeding one thousand dollars or, where some different sum is prescribed by regula tions made under this Act, to any amount not exceeding that different sum,";
(c) (i) by inserting in paragraph (a) of subsection one of section thirty-nine after the word "Wales" the words "or in any bank prescribed by regulations made under this Act, by way of deposit";
(ii) by inserting in paragraph (b) of the same sub section after the word "funds" the words "or in any other securities authorised by law for the investment of trust funds";
(d)
(d) (i) by omitting from subsection one of section forty-eight the words "six thousand dollars" and by inserting in lieu thereof the words "seven thousand five hundred dollars";
(ii) by inserting in the same subsection after the word "amount" the words ", or five hundred dollars by way of funeral expenses (as referred to in paragraph (c) of subsection one of section ten of this Act) for each funeral";
(iii) by omitting from the same subsection the words "five hundred and twenty dollars" and by inserting in lieu thereof the words "sh hundred and fifty dollars";
(iv) by omitting from the same subsection the words "twenty-one dollars" and by inserting in lieu thereof the words "thirty dollars";
(v) by inserting at the end of the same subsection the following new proviso :—
Provided that where some different sum is prescribed by regulations made under this Act in substitution for any sum specified in the foregoing provisions of this subsection, this subsection shall be read and construed as if the substituted sum were the sum so specified.
(vi) by omitting from subsection two of the same section the word "aforesaid" and by inserting in lieu thereof the words "specified in sub
are affected by any substitution referred to in section one of this section, or where such sums the proviso to that subsection, such sums as so affected"; (e)
by inserting at the end of section fifty-four the following new proviso :—
Provided further that where some different
amount is prescribed by regulations made under this
Act in substitution for any amount specified in
Schedule
Schedule Four to this Act, that Schedule shall be read and construed as if the substituted amount were the amount so specified.
(f) by omitting from subsection two of section one hundred and three the word "manager" and by inserting in lieu thereof the word "secretary"; (g) (i) by omitting from the short heading to section one hundred and fourteen the words "Military and naval" and by inserting in lieu thereof the words "Military, naval and air";
(ii) by omitting from subsection one of the same section the words "military or naval" where firstly occurring and by inserting in lieu thereof the words "military, naval or air";
(iii) by omitting from the same subsection the words "military or naval duty" and by insert ing in lieu thereof the words "duty in any of those forces";
(h) (i) by omitting from subsection one of section one hundred and sixteen the words "a sum not exceeding one shilling in place of all fees or payments otherwise payable" and by inserting in lieu thereof the words "the fee prescribed by regulations made under section two hundred and two of the Conveyancing Act, 1919, as amended by subsequent Acts,";
(ii) by omitting from subsection two of the same section the word "sum" and by inserting in
lieu thereof the word "fee";
(iii) by omitting from the same subsection the words "not exceed sixpence" and by insert ing in lieu thereof the words "be the fee prescribed by regulations made under section two hundred and two of the Conveyancing Act, 1919, as amended by subsequent Acts, in respect thereof";
(iv)
(iv) by omitting from subsection three of the same section the words "a sum not exceeding three pence for so doing" and by inserting in lieu thereof the words "a fee for so doing no! exceeding the fee prescribed by regulations made under section two hundred and two of the Conveyancing Act, 1919, as amended b} subsequent Acts, in respect thereof".
(1) The amendment made by subparagraph (ii) of paragraph (d) of section two of this Act shall apply to and in respect of the insurance of money, to be paid for funeral expenses (as referred to in paragraph (c) of subsection one of section ten of the Friendly Societies Act, 1912, as amended by subsequent Acts), first effected after the commencement of this Act

(2) Any such insurance effected before the commence ment of this Act to a sum in excess of five hundred dollars for each funeral (whether from any one or more societies, or branches, registered under the Friendly Societies Act, 1912, as amended by subsequent Acts) shall not be affected by the amendment made by subparagraph (ii) of paragraph (d) of section two of this Act :
Provided that any insurance so effected for an amount in excess of five hundred dollars shall not be increased beyond the amount for which it was so effected.
