FRIENDLY SOCIETIES (AMENDMENT) ACT.

Act No. 16, 1948.

An Act to amend the Friendly Societies Act, 1912-1942, in certain respects; to validate certain matters; and for purposes connected therewith. [Assented to, 21st May, 1948.]

BE it enacted by the King's Most Excellent Majesty, lative Council and Legislative Assembly of New South by and with the advice and consent of the Legis­ Wales in Parliament assembled, and by the authority of
the same, as follows :—
1. (1) This Act may be cited as the "Friendly Societies (Amendment) Act, 1948."
(2) The Friendly Societies Act, 1912, as amended by subsequent Acts and by this Act, may be cited as the Friendly Societies Act, 1912-1948.
2. (1) The Friendly Societies Act, 1912-1942, is amended:—

(a) (i) by inserting at the end of paragraph (h) of subsection one of section ten the following word and new paragraph:—

(ii).

" o r

(i)   the establishment, management and maintenance or joining or co-operat­ ing with any other friendly society or friendly societies in the establish­ ment, management and maintenance of homes, refuges or other institu­ tions for the accommodation, relief or care of members, their husbands, wives or dependants, or of the widows or widowed mothers of deceased members."

(ii)   by omitting from the same subsection the symbols and word " ( g ) and ( h ) " and by inserting in lieu thereof the symbols and

word " ( g ) (h) and ( i ) " ;
(b) by inserting at the end of section forty-four the words " o r charitable or provident purpose";

(c) (i) by omitting from subsection one of section forty-eight the words " two hundred pounds" and by inserting in lieu thereof the words "five hundred pounds";

(ii)   by omitting from the same subsection the words and symbols "(except as provided by this Act) fifty pounds" and by inserting in lieu thereof the words "one hundred and

four pounds" ;

(iii)   by omitting from the same subsection the words "forty-two shillings" and by insert­ ing in lieu thereof the words "five pounds five shillings";

(d) (i) by omitting from section fifty-four the words "on the death of a child under five years of age any sum of money which, added to any amount payable on the death of that child by any other society or branch, exceeds six

pounds, o r " ;

(ii)   by omitting from the same section the words "exceeds ten pounds" and by inserting in lieu thereof the words "exceeds the amount

specified in Schedule Four to this Act and
applicable to the case" ;
(e) by omitting subsection one of section fifty-seven and by inserting in lieu thereof the following subsection:—

(1) A registrar of deaths shall not give any one or more certificates of death of a child under the age of ten years for the payment in the whole of any sum of money exceeding the amount payable under section fifty-four of this Act and Schedule Four to this Act on the death of that child.

(2) Where before the commencement of this Act the rules of any registered society have made provision for the benefits referred to in paragraph (i) of subsection one of section ten of the Friendly Societies Act, 1912-1948 (as inserted by subsection one of this section), such rules shall, subject to the said Act, be deemed to have been valid and effectual as from the date of registration thereof.
