[ASSENTED TO 24TH NOVEMBER, 1938.] B E it enacted by the King's Most ]Jxcellent Majesty, by and with the advice and consent of the Legis- lative Assembly of Queensland in Parliament assembled, and by tHe authority of the same, as follows;- Short title 1. (1.) This Act may be cited as "The Friendly : ~ ~structio Societies Acts Amendment Act of 1938," and shall be n' read as one with *" The Friendly Societies Acts, 1913 to 1935," herein referred to as the Principal Act. 1938. SOCIETIES. Friendly Societies Acts Amendment Act. 17255 Amendments of the Principal Act. 2. The definition of " Friendly Societies" in section Amendment two of the Principal Act is amended by adding to para- of s. 2. graph (b) of the definition the words" or to members of the public generally and whether members of the society concerned or not." 3. A new section 25A is inserted after section New s. 25A. twenty-five of the Principal Act as follows:- "[25A.] (1.) Notwithstanding anything to the Audit of contrary contained in this Act but subject as hereinafter accounts. provided, every friendly society, which is so constituted that it has a central body and district branches, and every such district branch shall cause the books and accounts of such society or district branch to be audited annually by an auditor who shall be an auditor certified as competent as such pursuant to *" The Trust Accounts Acts, 1923 to 1925," and regulations thereunder; and for the time being empowered to audit trust accounts under such lastmentioned Acts and regulations, and the provisions of such lastmentioned Acts and regulations shall as far as applicable, mutatis mutandis, apply to the auditor and to the audit of the books and accounts of the society or district branch concerned. Any regulations necessary to give effect to this section in amendment of or modification of the regula- tions under *" The Trust Accounts Acts, 1923 to 1925," may be made accordingly. The auditor shall forward two copies of his report of audit direct to the registrar, who shall thereupon furnish one copy thereof to the society or district branch concerned with any annotations andlor recommendations or directions which the registrar may deem fit to make. (2.) Notwithstanding anything to the contrary Audit of contained in this Act the registrar may require any : ~ b~ unts of district branch of a friendly society referred to in sub- branches, section one hereof to cause the books and accounts of lodges, &c. any branch, sub-branch, or lodge or other body comprised in the district of, or Elissociated with, such district branch to be audited under and pursuant to subsection one of this section, and thereupon all of the provisions of subsection one of this section shall apply and extend with respect to such audit. 14 Geo. In the event of any dispute arising as to whether ' ~ : s~ ric: rrn any branch is a " district branch" within the meaning branch." of this section, the decision of the registrar shall be final and conclusive and without appeal to any tribunal whatsoever." A new section 62A is inserted after section sixty-two of the Principal Act as follows :-- Power to authorise a society to apply to become an approved society within the meaning of the NationalHealth andPensionsInsuranceAct 1938 (of the Common- wealth), (No. 25 of 1938). "[62A.] (1.) INotwithstanding anything contained in this Act, any society or section of a society may, pursuant to a resolution passed at a special meeting of the members of such society or section called for the purpose or passed according to the rules andlor practice of the society or section concerned, resolve to apply, and thereupon may apply, to the National Insurance Commission constituted under and pursuant to an Act of the Commonwealth called the *National Health and Pensions Insurance Act 1938 to become an approved society within the meaning of such lastmentioned Act. Eff?ct of (2.) In the event of any such society or section of a b so e C c l o e m t~ mg a soci n ety bec . oming pursuant to any such appli$)ation a . n ap~ roved approved SOCIety under and for the p:urposes of the saId * SOClety. the NationalHealthandPensionsInsuranceAct1938, such society or section shall, under the name or style of such approved society as so approved by the said National Insurance Commission, be subject to the provisions of such lastmentioned Act and shall have and may exercise all the rights, powers, and privileges, and be subject to all the conditions, liabilities, and penalties set forth in such lastmentioned Act as appertain to or are imposed upon approved societies thereunder. When society deemed separate entity. (3.) Any society or section of a society becoming an approved society under the said the * NationalHealthandPensions InsuranceAct1938 shall be and be deemed a separate corporation or body distinct from the society or section concerned and shall be bound by the rules of the society or section as an approved society, which rules are from time to time approved by the National Insurance Commission and are for the time being in force. * No. 25, 1938.

Any society or section of a society complying Adv.an.ce for with subsection one of this section may out of its funds ~ ~;= ~ held by it pursuant to this Act make such advances as it shall deem fit and proper to meet the preliminary expenses to be incurred by it in and towards its becoming an approved society under the aforesaid the * NationalHealthandPensionsInsuranceAct1938. Any advances so made from the funds of the society or section of a society held under this Act shall be recouped by repayment back to such funds from such moneys as may be made available to the approved society by the National Insurance Commission for such purpose. (5.) Notwithstanding anything in this Act contained, VolWltary. any assured member of an approved society under the membership. *National Health and Pensions Insurance Act 1938 may notwithstanding such membership be and become a voluntary member of any society whether an approved society as aforesaid or not upon complying with the provisions of this Act and the rules of the society in question. (6.) For the purposes of this section the term Inter- . All acts, matters, and things done or executed Ratification. by .any society or section of a society prior to the coming into force of this Act, which if done subsequent to the coming into force of this Act would be valid and lawful, are hereby approved, validated, ratified, and confirmed." n. 5. Schedule to the Principal Act is hereby Amendments amended as follows :_ to Sch. IT. (a) The following proviso is added to rule nine of New r. 9. the said Schedule, namely :- "Provided that any dispensary established pursuant to this rule may in addition to supplying, dispensing, and/or selling to the members or wives or dependents of members of the society or branch concerned supply, dispense, and/or sell to members of the public generally and whether members of the society or branch concerned or not." * No. 25, 1938.

Friendly Societies Acts Amendment Act of 1938" been established, or subsequent to such passing shall be established, with the object of supplying medical requisites or dispensing medicines to members, their husbands, wives, widows, parents, children or kindred, shall have, and is hereby declared to have always had, power and authority to so sell or supply medical requisites or dispense and/or sell medicines to members of the public generally whether members of the society or not in the same manner and to the same extent as any pharmaceutical chemist registered under *"The Pharmacy Acts, 1917 to 1936," may so supply, dispense, and/or 'sell. * 8 Geo.
