AN ACT to Vest certain Lands in the Munici- pality of Fremantle in the " Trustees of the Fremantle Cemetery."
[Assented to 6th February, 1909.]
HEREAS the lands described in the first column of the first Preamble.
bodies or trustees, as set out in the second column of the saidWpart of the schedule hereto are vested in various religious
schedule, for the purposes set out in the third column of the first part of the said schedule: And whereas the land described in the second part of the said schedule was on the twenty-ninth day of July, 1852, reserved and set apart for the purpose of a cemetery : And whereas the said lands are used for the purpose of a Cemetery known as the Skinner Street Cemetery: And whereas it is expedient to vest the said lands in the " Trustees of the Fremantle Cemetery :" Be it therefore enacted by the King's Most Excellent Majesty, by and with the , advice and consent of the Legislative Council and Legislative Assembly of Western Australia, in this present Parliament assembled, and by the authority of the same, as follows:—

| Vesting of cemetery | 2. From and after the passing of this Act all right of property |
in trustees of the which may have at any time been vested by Statute or otherwise in
Fremantle
| Cemetery. | the persons or corporations mentioned in the second column of the first part of the said schedule or in any other person or persons or corporation whatsoever in any part of the lands described in the first part of the said schedule shall absolutely cease and determine, and that the whole of the said lands, together with the land described in the second part of the said schedule, and all the right and title in law or equity there o shall he and the same are hereby vested in the " 'trustees of the Fremantle Cemetery," freed and released from all and every trusts or trust now affecting the same. |
Schedules. 3. The whole of the lands described in the first and second parts of the said schedule shall be deemed a disused burial ground within the meaning of the Cemeteries Act Amendment Act, '902.
