An Act to render valid a certain Loan raised by the Municipality of Fremantle, and to indemnify the said Municipality against all legal proceedings consequent on any irregularity or illegality in the mode of the raising of the said Loan.

[Assented to 4th December, 1889.

HEREAS a certain loan known as Loan No. 5, being a loan

WJuly, 1889, at five and a half per cent., was raised by the Munici-of the sum of £5,000 for twenty years from the 31st day of

to give validity to the said loan, and to indemnify the said Munici-i

pality against any actions at law which may be brought against the

said Municipality in respect of the manner of raising the said loan :

Be it therefore enacted by His Excellency the Governor of Western Australia and its Dependencies, by and with the advice and consent of the Legislative Council thereof, as follows :—

1. Notwithstanding the provisions of the law were not complied Lnzul of 31st July,

with by the Municipality of Fremantle in raising the said loan, never- 1889

theless the said loan shall be good and valid for all purposes ; and all

bonds or securities given to secure the same shall be also good and

valid, and the rate made and levied hi respect of this loan shall also

be good and valid.

2. No action at law shall be brought against the Municipality of Municipality to

Fremantle, or any member thereof, by reason of any irregularity or be imia"ified

-illegality in the manner of raising the said loan ; and the said Munici-

pality, and all and every person or persons who has or have incurred

any penalty or forfeiture by any act or omission in and about the raising of the said loan, shall be acquitted and discharged of and from and indemnified against the same, anything in any Act to the contrary

notwithstanding.
