AN ACT to provide for the Disposal of the

Funds of the Fremantle Jockey Club.

[Assented to 29th September, 1906.]

\NT HEREAS the Fremantle Jockey Club is now possessed of

certain trust funds amounting to two hundred and eighty-

eight pounds ten shillings and tenpence: And whereas the present

trustees. of the said club are Elias Solomon, John Joseph Higham,

and Robert Hardy Holmes, all of Fremantle: And whereas the said

club has for a considerable time past ceased to -carry out the objects

for which it was formed : And whereas the said trustees are desirous

of applying the said funds for purposes other than those originally

intended and as hereinafter set forth: Now be it enacted by the

King's Most Excellent Majesty, by and with the advice and consent

of the Legislative Council and Legislative Assembly of Western

Australia, in this present Parliament assembled, and by authority of

the same, as follows:—

1. Notwithstanding any trust to the contrary to which the same

effecting improvements to the golf links of or land occupied by the Fremantle Golf Club at High Street, Fremantle, containing about one hundred and fifty-six acres, and being part of Permanent Reserve No. A 6638 ; or for the purpose of further and better fitting the said land for recreation and for the promotion of athletic pas- times thereon.

2. Tt shall be lawful for the said trustees to pay over all such

bound to see to the proper expenditure thereof, and without being liable for such payment or for the application, non-application, or misapplication of the said moneys.

3. The nature of the aforesaid improvements, and the time and mode of effecting the same, shall be m the sole and absolute discretion of the said Mayor and Councillors of the Municipality of Fremantle.

Costs of Act. 4. Prior to handing over the said moneys, the said trustees

may deduct therefrom the costs. charges, and expenses incurred by them in connection with this Act, provided that such costs and expenses shall not exceed five pounds.
