AN ACT to amend sections three and eight of the Fremantle Gas and Coke Company's Act, 1886, and for other purposes incidental thereto.

BE it enacted by the King's Most Excellent Majesty, by and with the advice and consent of the Legis- lative Council and Legislative Assembly of Western Australia, in this present Parliament assembled, and by the authority of the same, as follows:-

Short title.

1. This Act may be cited as the Fremantle Gas and

Coke Company's Act Amendment Act, 1938, and shall

1938.] Fremantle Gas and Coke Company's. [No. 15. be read as one with the Fremantle Gas and Coke Com- pany's Act, 1886 (No. 34 of 1886), as amended by the Fremantle Gas and Coke Company's Act, 1886, Amend- ment Act, 1893, hereinafter referred to as the principal Act.

2. Section three of the principal Act is amended as follows:	Amendment

(a)	by adding at the end of the section the words "and every other place, outside the said circle of five miles but within that portion of the State described in the First Schedule to this Act, to which the Governor may from time to time by proclamation declare that this Act shall extend";
(b)	by adding to the section (as amended by para-

graph (a) hereof) a proviso as follows:

Provided that the Governor shall not make or issue any proclamation under this section to extend the limits of this Act to any place afore- said which is situate within that portion of the State described in the First Schedule to this Act and also within the district of any municipal council or of any road board unless and until the municipal council or the road board con- cerned (as the case may be) has by resolution consented thereto.

3. Section eight of the principal Act is amended by deleting the word "schedule" in line two of the section and inserting in lieu thereof the words "Second Schedule." of s. 8.

All that portion of land hounded by lines starting from a point on the sea coast due west of the centre of North street and extending easterly along the said centre of street and onwards to the eastern alignment of Servetus street; thence northerly and easterly along boundaries of Lot 73 of Swan Location P1071 to the western boundary of Lot 74; thence northerly along the latter boundary and onwards to the north-eastern corner of Lot 64; thence easterly to the south- eastern corner of Lot 29 to Location P1069; thence southerly to a

point in prolongation westerly of the southern boundary of Lot 1 of Location P1070; thence easterly to and along the said boundary, onwards to and along the southern boundary of Lot 0, and continuing to the eastern alignment of Australind street; thence southerly along the said alignment to the north-western alignment of Claremont cres- cent; thence north-easterly along the latter alignment to the south- western corner of Subdivisional Lot 5 of Lot 30 of Swan Location 702; thence northerly and easterly along the boundaries of said Lot 5 and onwards to the western boundary of Subdivisional Lot 6 of Lot 31; thence northerly and easterly along boundaries of said Lot 6 and onwards to the north-eastern corner of Subdivisional Lot 15 of Lot 33; thence southerly along the eastern boundary of said Lot 15 and onwards to the northern boundary of the Eastern Railway Reserve; thence easterly along the said boundary of reserve to a point in prolongation northerly of the western boundary of Lot 3 of said Location 702 as shown on Land Titles Office Plan 2290; thence southerly to and along the said western boundary; thence south-south-easterly to the north- western corner of Subdivisional Lot 44 of Lot 10 and onwards in this direction to the south-western corner of Subdivisional Lot 34 of Lot 23; thence easterly and southerly along boundaries of Subdivisional Lot 18 of Lot 24 to the northern alignment of Chatsworth terrace; thence south-easterly to the north-eastern corner of Subdivisional Lot 3 of said Lot 24; thence south-south-easterly, east-north-easterly, southerly, and again south-south-easterly along boundaries of the said Lot 3 and boundaries of Subdivisional Lot 2 of Lots 1 and 2 of Lot 24, and onwards in the latter direction to the centre of Stirling highway; thence south-westerly along the said centre of highway to a point in prolongation northerly of the western boundary of that portion of Swan Location 616 as shown on Land Titles Office Diagram 3764; thence southerly to and along the said western boundary to its inter- section with the arc of a five-mile radius from the centre of the Fre- mantle Town Hall; and thence generally west-north-westerly along said are to its point of intersection with the centre of North street; thence westerly along centre of North street to the starting point.

Amendment 5.

The schedule to the principal Act is amended by deleting the heading "Schedule" and inserting in lieu thereof a heading as follows:—"Second Schedule (Sec- tion 8)."
