Part 1—Preliminary

1—Short title

These regulations may be cited as the Freedom of Information (Fees and Charges) Variation Regulations 2010.

2—Commencement

These regulations will come into operation on 1 July 2010.

3—Variation provisions

In these regulations, a provision under a heading referring to the variation of specified regulations varies the regulations so specified.

4—Substitution of Schedule 1

Schedule 1—delete the Schedule and substitute:

On application for access to an agency's document (section 13(c))

$28.75

(1)

For dealing with an application for access to an agency's document and in respect of the giving of access to the document (section 19(1)(b) and (c))—

    (a)    in the case of a document that contains information concerning the personal affairs of the applicant—

     (i)     for up to the first 2 hours spent by the agency in dealing with the application and giving access

no charge

     (ii)    for each subsequent 15 minutes so spent by the agency

$10.70

    (b)    in any other case—for each 15 minutes so spent by the agency

$10.70

(2)

In addition to the fees specified in subclause (1), the following fees are payable in respect of the giving of access to an agency's document:

    (a)    where access is to be given in the form of a photocopy of the document (per page)

$0.15

    (b)    where access is to be given in the form of a written transcript of words recorded or contained in the document (per page)

$6.40

    (c)     where access is to be given in the form of a copy of a photograph, x‑ray, video tape, computer tape or computer disk

the actual cost incurred by the agency in producing the copy

Note—

If the applicant requires that a document be posted or delivered, the applicant must pay the actual costs incurred by the agency in posting or delivering the document.

On application for review by an agency of a determination made by the agency under Part 3 of the Act (section 29(2)(b))

Note—

As required by section 10AA(2) of the Subordinate Legislation Act 1978, the Minister has certified that, in the Minister's opinion, it is necessary or appropriate that these regulations come into operation as set out in these regulations.
