Freedom of Information Amendment Act 2001

An Act to amend the Freedom of Information Act 1991

[Royal Assent 16 July 2001]

Be it enacted by His Excellency the Governor of Tasmania, by and with the advice and consent of the Legislative Council and House of Assembly, in Parliament assembled, as follows:

1Short titleThis Act may be cited as the Freedom of Information Amendment Act 2001 . 2CommencementThis Act commences on the day on which this Act receives the Royal Assent. 3Principal ActIn this Act, the Freedom of Information Act 1991 is referred to as the Principal Act. 4Section 5 amended (Interpretation) Section 5(1) of the Principal Act is amended as follows: (a) by omitting "Act;" from paragraph (e) of the definition of prescribed authority and substituting "Act; or"; (b) by inserting the following paragraph after paragraph (e) in the definition of prescribed authority : (f) the Law Society of Tasmania established under the Law Society Act 1962 and continued as a body corporate under the Legal Profession Act 1993 ; 5Section 32B insertedAfter section 32A of the Principal Act , the following section is inserted in Part 3: 32BInformation relating to Law Society Without limiting the application of any other exemption under this Act, information contained in records in the possession of the Law Society of Tasmania established under the Law Society Act 1962 and continued as a body corporate under the Legal Profession Act 1993 is exempt information unless it relates to the performance and exercise of the functions and powers under Parts 8 and 9 of the Legal Profession Act 1993 .
