REASONS FOR DECISION TO DISMISS OBJECTION APPLICATIONS
Background
[1] On the dates specified in the attached Schedule, the Government party gave notice under s 29 of the Native Title Act 1993 (Cth) of its intention to grant certain mining tenements (‘the proposed licences’) to the grantee parties specified therein and included in the notices a statement that it considered that the grants attracted the expedited procedure.
[2] On the dates specified in the attached Schedule the native title parties made expedited procedure objection applications to the Tribunal in respect of the proposed licences.
[3] On 16 December 2008 the Government party advised the Tribunal that it had withdrawn the expedited procedure statement for each of the proposed licences listed in the attached schedule (s 32(7) - Native Title Act).
Conclusion
[4] The Tribunal has no jurisdiction to conduct an inquiry as the Government party no longer considers the acts to attract the expedited procedure.
Decision
[5] The objection applications specified in the attached Schedule are dismissed pursuant to s 148(a) of the Native Title Act 1993 (Cth).
